BE ZT ORDAINED BY THE COUNCZL OF THE C�TX O�' CAPE GIRARDEAU,
MZSSOURI, AS �OLLOW5:
SECTION 1. It sh:all be unlawful �or any person, individuallX
or in concert �ith others to camp, _pitch tents, take up temporary
or permanent residence or remain overnight in a part or on public
property in the City� of Cape Girardeau, Mi��ouri, exaept tIze City
Council may grant a �ermit for the purpose of camping, when it is.
sh.oHrn th.at proper �acilities to accomodate the campers will be made
available and that th.is activity �rill not i.ntexfere inrith the normal
use of the area for wi�ich the permit is granted. Any person making
an application to camp under the terms of tha::s ordinance may be
requi,red by the City Counci.l to f.ile inrith the Cit�r Clerk, a bond in an
amount suffici.ent to cover any possi,ble damages to the park or to
public property.
SECTION 2. Penalties. Any per�on v.iolating any of the
provisions of th.is ordinance shall be deemed guilt�r of a misdemeanor
and upon conviction thereof shall be fined an amount not exceEding
One Hundred Dollars ($100. OQ) or to be imprisoned in the Cape
Girardeau City Jail for a period not exceedi.ng ninety (90) days or
be both so fined and imprisoned.
SECTION 3. Separab'ility. If any section, subsection,
sentence, clause, phrase or portion of tT�.is ordinance is for any
reason held invalid or unconstitutional by any Court of competerit
jurisdi.ction, such portion shall be deemed a separate, distinct,
and independent provision and such holding shall not affect the
validity of the remaining portions hereof.
SECTION 4. Reriumbering. It is the intention of the governing
body and it is Izereby ordained that the provision� of this ordinance
shall become and be made a part of the Code of Ordinances, City
of Cape Girardeau, Mis�ouri, and the s�ection� of tYri:s Code may be
renumbered to accomplish such intention.

�ECTION 5. Event� may occur at an� time �o that it is
neces�ary for t�e immediate preservation o� t�e public peace,
property, health and �afety and create a �tate of emergency, thezefoxe,
this ordinance shall take effect immediatel� upon it� pa�sage and
approval.
