BE IT ORDAZNED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MZSSOURI, AS �'OLLOTn�S:
SECTTON l. That a plat and dedication of Oak Park
Subdivision �as filed in the Recorder's Offi.ce of Cape Girardeau
County, Missouri, at Jackson, Missouri, on July 20, 1940, in
Plat Book 4 at Page 41. This subdivision �ras i.ncorporated within
the City Limits of Cape Girardeau, Missouri, and the plat and
dedication of Oak Park Subdivision establi.shed easements for
service pole lines, consisting of a strip of land four (4� feet
�ride parallel with and adjacent to the rear of Lots 1,2,3,4,5,
6, 7, 8, 12, 13, 14 and 15 and parallel v�ri:th and adjacent to the
sides. of lots numbered 8 and 12, All of Block 3, of Oak Park
Subdivision.
SECTION 2. Cape Girardeau Federal Savings and Loan
Associ.ation .�s the present owner of Lot� 1, 2, 3, 4, 5, 6, 7,
8, 12, 13, 14 and 15 of Block 3 of said �ubdivi�ion, and desires
to erect a b uilding or buildings on said Lots in Block 3 and
by reason the.reof desi.res a release of the easements.
SECTION 3. The easements dedicated to a stri� of land
four (4) feet wide parallel �rith and adj acerit to tIie rear of
each of lots numbered 1, 2, 3, 4, 5, 6, 7, 8, 12, 13, 14 and 15
of Block 3 and parallel �nrith and adjacerit ta. the sides of lots
numbered 8 and 12 of Block 3 of Oak Park Subdivi,sion, excepting
the TnTest five (5} feet of Lots l and 5, Block 3, Oak Park
Subdivision, are not necessary or needed for any of the public
purpos�s for �rhich they were established.
5ECTION 4. In consideration of the sum of One Dollar ($1.00�
the receipt and sufficiency of which is IiereIay acknov�rledged, the
City of Cape Girardeau, Mi�souri, does hereb� rele.ase, remise,
relinqui�h, surrander and forever quit clai.m all i.ts rigIzt, title

and intere�t in and to a �trip of land four (4� feet wide parallel
�ith and adjacent to the rear of each of lots numbered l, 2, 3,
4, 5, 6, 7, 8, 12, 13, 14 and 15 of Block 3 and parallel with and
adjacent to th.e s�des of lot� numbered 8 and 12 of Block 3 of
Oak Park �ubdivision, excepting the West five (5) feet of Lots
1 and 5, Block 3, Oak �ark Subdivision unto Cape Girardeau
Federal Savings and Loan A�sociation, its �ucces�ors, executors,
administrators, personel representatives and assigns.
5ECTION 5. The Mayor of the City of Cape Girardeau, Missouri,
is herelaX authorized and empo�tered to execute and deliver a release
of the de�cribed easements to Cape Girardeau Federal Savings and
Loan Association, who are the present o�ners of the property
described above.
SECTION 6. This ordinance shall be in full force and effect
ten days after i.ts pas�age and approval.
