AN ORDINANCE GRANTING A SPECIAL USE PERMIT TO RAYMOND B. HUNZE
AND CHARLES L. HUNZE, FOR THE PURPOSE5 OF PLACING AND MAINTAINING
A MOBILE HOME AS FARM CARETAKER RE5IDENCE, TO BE LOCATED ON PART
OF 5ECTION5 13, 12, 18 AND 7, TOWNSHIP 31, RANGE 12 EAST, CITY
AND COUNTY OF CAPE GIR.ARDEAU, MI550URI
WHEREA5, Raymond B. Hunze and Charles L. Hunze are the
owners of certain property in the City of Cape Girardeau, Missouri,
on which they desire to place and maintain a mobile home as a
farm caretaker residence; and
WHEREA5, the proposed location of the said mobile home
is a tract of land containing approximately 465 acres known as
the Hunze Farm, 2403 South Sprigg Street, Cape Girardeau, Missouri,
which said property is presently zoned M-2; and
WHEREAS, the Zoning Code of the City of Cape Girardeau
requires a Special Use Permit be granted for a residential use for a
caretaker in a heavy industry zone;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCII� OF THE
CITY OF CAPE GIRARDEAU, MIS50URI, AS FOLLOW5:
SECTION 1. The City Council, having duly considered the
application finds that the granting of the Special Use Permit
will not substantially increase traffic hazards, congestion, fire
hazards or adversely affect the general character of the
neighborhood or the general welfare of the community, nor will it
overtax pub liC utilities or be in conflict with the comprehensive
plan.
SECTION 2. A Special Use Permit for the purposes of
placing and maintaining a mobile home as a farm caretaker residence
in Cape Girardeau, Missouri , on the following described property:
A tract containing approximately 465 acres of
land, 365 acres being tillable and all known as the
Hunze Farm, located within the city limits of City of
Cape Girardeau, and being part of the North half of
5ection 13, part of the south half of Section 12, part
of the west half of the Northwest Quarter of Section 18,
and part of the south half of Section 7, Township 31,
Range 12 east, in Cape Girardeau County, Missouri
is hereby granted to Raymond B. Hunze and Charles L. Hunze, to be
effective ten (10) days after the date of passage and approval
of this ordinance. The special use must comply with all regulations
set forth in the Zoning Code for the district in which the use is
located except those which have been specifically excepted under
this permit, all other applicable ordinances of the City of Cape
Girardeau and any special conditions contained in the 5pecial Use
Permit, a copy of which is attached hereto, marked "Exhibit A"
and incorporated here 'in by reference . The Mayor is hereby given
the power to execute the 5pecial Use Permit for and on behalf of
the City of Cape Girardeau, Missouri.
SECTION 3. This ordinance shall be in full force and
effect ten days after its passage and approval.

SP�CIAL USE PERMIT
Raymond B. Hunze and Charles L. Hunze, are hereby granted
a Special Use Permit for the purpose of placing and maintaining
a mobile home as a farm caretaker residence in the City of Cape
Girardeau, Missouri, on the following described property for a
three (3) year period:
A tract containing approximately 465 acres of land,
365 acres being tillable and all known as the Hunze
Farm, located within the city limits oi City of Cape
Girardeau, and being part of the North half of
Section 13 , �art of the south 'zalf of 5ection 12, part
of the west half of_ the rdorthwest Quarter of Section 18,
and part of the south half of Section 7, Tocanship 31,
Range 12 east, in Cape Girardeau County, n2issouri .
The 5pecial Use Permit is granted upon the condition that
the Applicants be bound by all City Ordinances which pertain to
the Special Use Permit and that the AppliCants be ��ound by the
following conditians which are imposed as a condition of issuance
of_ this Special Use Permit. Upon the failure of the Applicants to
comply with these special conditions , the 5pecial Use Permit will
automatically terminate with the right of the City of Cape
Girardeau to enter upon the land to abate such special use .
5PECIAL CONDITIONS:
1. Use restricted to caretaker use only, and employed
on the far�.
2. This Special Use Permit is for a three (3) year
period only.

This Special Use Permit shall be binding upon the tenants,
heirs, successors and assigns of Raymond B . Hunze and Charles L.
Hunze.

in behalf of said City by authority of its City Council and
acknowledged said instrument to be the free act and deed of said
City.
