AN ORDINANCE GRANTING A SPECIAL USE PERMIT TO FARMERS & MERCHA.NTS
BANK OF CAPE GIRARDEAU, A BANKING CORPORATION, FOR THE PURPO5ES
OF CONSTRUCTING, MAINTAINING AND OPERATING A PARKING LOT, TO BE
LOCATED ON PART OF OUT LOT5 56 AND 57, CITY AND COUNTY OF CAPE
GIRA.RDEAU, MI550URI
WHEREAS, Farmers & Merchants Bank of Cape Girardeau, a
banking corporation, is the owner of certain property in the City
of Cape Girardeau, Missouri, on which it desires to construct,
maintain and operate a parking lot; and
WHEREA5, the proposed location of the said parking lot
is 2029 , 2101 and 2103 Good Hope Street, Cape Girardeau, Missouri,
which said property is presently zoned R-l; and
WHEREAS, the Zoning Code of the City of Cape Girardeau
requires a 5pecial Use Permit be granted for a commercial use in
a residential zone;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE
CITY OF CAPE GIRARDEAU, MI5SOURI, A5 FOLLOWS:
SECTION 1. The City Council, having duly considered the
application finds that the granting of the Special Use Permit will
� not substantially increase traffic hazards, congestion, fire hazards
or adversely affect the general character of the neighborhood or
the general welfare of the community, nor wi11 it overtax public
utilities or be in conflict with the comprehensive plan.
SECTION 2 . A 5pecial Use Permit for the purpose of
constructing, maintaining and operating a parking lot in Cape
Girardeau, Missouri, on the following described property:
All Lots One (1) and Two (2) of Ulrich ' s Subdivision
of Block Three (3) of Schneider' s Subdivision of Out
Lots 56 and 57, in the City of Cape Girardeau, Missouri .
AL5�, All of East 1/3 of Lots l and 2, in Block
Two (2) of Schneider' s Subdivision of a part of Outlots
56 and 57, as the same is laid down and designated on the
recorded plat of said subdivision of record in the
reCorder' s office at Jackson, Missouri, in Plat Book
Three (3) at page Fifty-seven (57) .
is hereby granted to Farmers & Merchants Bank of Cape Girardeau,
a banking corporation, to be effective ten (10) days after the date
of passage and approval of this ordinance . The special use must
comply with all regulations set forth in the Zoning Code under
§ 30-38 (C) (20) and all other regulations for the district in which
the use is located except those which have been specifiCally
excepted under this permit, all other applicable ordinances of the
City of Cape Girardeau and any special conditions contained in the
Special Use Permit, a copy of which is attached hereto, marked
"Exhibit A" and incorporated herein by reference. The Mayor is
hereby given the power to execute the 5pecial Use Permit for and on
behalf of the City of Cape Girarde au, Missouri .
5ECTION 3 . This ordinance shall be in full force and
effect ten days after its passage and approval.

This 5pecial Use Permit shall he binding upon the
successors and assigns of Farmers and .Merchants Bank of Cape
Girardeau, a banking corporation.
IN WITNESS G�]HEREOF, the Mayor of the City of Cape
Girardeau affixes his signature this day of 1972 .

being by me duly sworn, did say that he is the Mayor of the City
of Cape Girardeau, a municipal corporation of the State of Missouri,
and that the seal affixec� to the foregoing instrument is the seal
of the said City and that the said instrument was signed and sealed
in behalf of said City by authoritl� of its City Cauncil and
acknowledged said instrum�nt to be the free act and deed of said
City.

SPECIAL USE PERMIT
Farmers & Merchants �ank of Ca�e Girardeau, a banking
corporation, is hereby granted a Special Use Permit for the
purpose of constructing, maintaining and operating a parking
lot in the City of Cape Girardeau, i�issourio on the folloEaing
described property for an indefinite period:
All Lots One (1) and Tcao (2) of Ulrich 's
Subdivision of Block Three (3) of Schnei�er' s
Subdivision of Out �,ot 56 and 57, in the City of
Cape Girardeau, Missouri .
ALSO, All of East 1/3 of Lots 1 and 2, in
Block Two (2) of Schneider' s Subdivision of a
part of Outlots 56 and 57, as the same is laid
down and desiqnated on the recorded plat of
said subdivision of record in the recorder' s
office at Jackson, Missouri , in Plat Book
Three (3) at page Fifty-seven (57) .
The Special Use Permit is granted u�on the condition that
the Applicant be bound by all City Ordinances �ahich pertain to the
Special Use Permit and partiCularly the provisions of � 30-38 (C) (20)
and that the Applicant be bound by the follo�,aing conditions which
are imposed as a condition of issuance of_ this Special Use Permit .
Upon the failure of the Ap�licant to compl_y with these special
conditions, the Special Use Permit will automatically terminate
with the right of the City of Cape Girardeau to enter upon the land
to ab ate such speci al use.
SPECIAL COiVDITION5:
l . Use is restricted to parking lot facilities and
related activities .
2. Special Use Permit not transferrab.le without consent
of the City Council.
