AN ORDINANCE AMENDING CHAPTER 20 OF THE CODE OF ORDINANCES OF
THE CITY OF CAPE GIRARDEAU, MISSOURI, BY ADDING THERETO CERTAIN
NEW S�CTIONS, PERTAINING TO THE CREATION OF A RECREATION BOARD
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE
CITY OF GAPE GIRA.RDEAU, MISSOURI , A5 FOLLOW5:
SECTION l. Chapter 20 of the Code of Ordinances of the
City of Cape Girardeau, Missouri, is hereby amerided, by adding
thereto certain new sections, as set out in 5ection 2 of this
ordinance, pertaining to the creation of a recreation board.
SECTION 2 . New sections shall be and hexeby are added
to the Code of Ordinances of the City of Cape Girardeau, Missouri ,
reading as follows:
"Article III. Recreation Board"
"5ec. Created; membership.
There is hereby created a board consisting of
seven (7) citizens of the City of Cape Girardeau,
Missouri, and one (l) ex officio member to be determined
as set out in 5ection (c) , which shall be known
and designated as the 'Cape Girardeau Recreation Board' . "
"Sec. Qualification of inembers; terms; ex
officio member; tenure; vacancy .
(a) Qualifications . A person appointed to the
Cape Girardeau Recreation Board shall be a taxpayer and
qualified voter of the city.
(b) Terms . The Council shall appoint the first
members of the recreation board for terms as follows:
Three (3) members shall serve for a term of three (3)
years commencing on t�ie effective date of this ordinance;
two (2) members shall serve for a term of two (2) years
commencing on the effective date of this ordinance and
two (2) members shall serve for a term of one (1) year

commencing on the effective date of this ordinance.
As the term of a member expires, the council shall
appoint a successor for a term of three (3) years.
(c) Ex officio member. The mayor or a councilman
designated by the mayor shall serve as an ex officio
member of the recreation board and shall maintain
liaison with the city council and city manager, but shall
not have a vote in the decisions of the recreation
board.
(d) Tenure. Members of the recreation board shall
serve at the pleasure of the city council.
(e) Vacancy. If a vacancy occurs on the
recreation board, the council shall fill the vacancy
by appointing a new member to serve the balance of the
unexpired term. "
"Sec. Meetings; bylaws .
The recreation board shall have regular meetings
every three (3) months and special meetings as often
as they are required. The recreation board shall adopt
bylaws to govern the conduct of its business . "
"Sec. Officers .
The recreation board shall meet each year between
the first day of May and the fifteenth day of May and
elect a chairman, vice-chairman and a secretary to serve
a term of one (1) year. "
"5ec. Powers and duties .
(a) The recreation board shall act in an advisory
capacity to the city council to review, promote, and
expedite existing and new public recreation activities;
to take an active part through its membership, subcommi.ttees ,
and such citizen committees as may be appointed by the

recreation board under authority of this ordinance to
locate physical facilities suitable for public
recreation, contact owners of such facilities to
request permission for such use, schedule recreation
activities and notify appropriate City of Cape
Girardeau employees and cooperating owners of other
properties of such scheduled use; and to act in other
respects as coordinators for public recreation,
utilizing all available city owned and other property
suitable for such use. The recreation board may meet,
confer or negotiate with any individual, partnership,
association, corporation, or local, state or federal
agent or governmental organization. The recreation
board may present a proposed plan or design to the city
council or city manager for implementation or approval
or adoption by ordinance where necessary, as provided
by law.
(b) The city council shall notify the recreation
board of a meeting at which major construction, operation,
maintenance or improvement of, or addition to a city
park or recreational facility is to be discussed in
detail. The city council or city manager shall relay to
the recreation board as soon as practicable , material
information pertaining to a city park or recreational
facility.
(c) The recreation board shall report the
condition of recreation development to the city council
the first week of February, May, August and November of
each year, or more frequently, if requested by the.
council.
(d) The board may submit to the council, in the
manner provided by law, a petition for the calling of a
special election on the proposition as to whether or not

bonds shall be issued for the expansion, construction,
improvement, equipment, maintenance, or operation of
recreational facilities . "
�" "5ec. Recreation budget.
(a) The recreation board may, on or before the
fifteenth day of May of each year, submit to the city
council for approval, a budget for recreational facilities
and programs, setting forth the expected income and
expenditures for the following fiscal year. "
SECTION 3. If any section, subsection, sentence, clause,
phrase or portion of this ordinance is for any reason heTd
invalid or unconstitutional by any Court of competent jurisdiction,
such portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining portions hereof.
SECTION 4. It is the intention of the governing body
and it is hereby ordained that the provisions of this ordinance
shall become and be made a part of the Code of Ordinances, City
of Cape Girardeau, Missouri , and the sections of this Code may
be renumbered to accomplish such intention.
SECTION 5 . This ordinance shall be in full force and
effect ten days after its passage and approval.
