CITY MANAGER FORM ORDINANCE NO. 'a
AN ORDINANCE REPEALING ARTICLE II, SECTIONS 20-15; 20-16 (a) ;
20-16 (b) ; 20-16 (c) ; 20-16 (d) ; 20-16 (e) ; 20-17; 20-18; 20-19 (a) ;
20-19 (b) ; 20-19 (c) ; 20-19 (d) ; 20-20 (a) ; 20-20 (b) ; and 20-20 (c)
OF THE CODE OF ORDINANCES OF THE CITY OF CAPE GIRARDEAU, MISSOURI,
PERTAINING TO PARKS AND RECREP,TION; AND ENACTING NEW SECTION5 IN
LIEU THEREOF
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE
CITY OF CAPE GIRARDEAU, MIS50URI, AS FOLLOWS:
SECTION l. That Article II , Sections 20-15; 20-16 (a) ;
20-16 (b) ; 20-16 (c) ; 20-16 (d) ; 20-16 (e) ; 20-17; 20-18; 20-19 (a) ;
20-19 (b) ; 20-19 (c) ; 20-19 (d) ; 20-20 (a) ; 20-20 (b) ; and 20-20 (c)
of the Code of Ordinances of the City of Cape Girardeau, Missouri,
are hereby repealed and new sections enacted in lieu thereof
as shown in Section 2 of this Ordinance.
SECTION 2. That new Article II, Sections 20-15; 20-16 (a) ;
20-16 (b) ; 20-16 (c) ; 20-16 (d) ; 20-16 (e) ; 20-17; 20-18; 20-19 (a) ;
20-19 (b) ; 20-19 (c) ; 20-19 (d) ; and 20-20 of the Code of Ordinances
of the City of Cape Girardeau, Missouri are hereby enacted reading
as follows:
"Article II. Park Board"
"Sec. 20-15 . Created; membership.
There is hereby created a board consisting of
six (6) citizens of the City of Cape Girardeau,
Missouri, and one (1) ex officio member to be determ.i.ned
as set out in 5ection 20-16 (c) , which shall be known
and designated as the 'Cape Girardeau Park Board' . "
"Sec. 20-16 . Qualifications of inembers; terms; ex
officio member; tenure; vacancy.
(a) Qualifications. A person appointed to the
Cape Girardeau Park Board shall be a taxpayer and
qualified voter of the city. "
" (b) Terms . The council shall appoint the first
members of the park board for terms as follows: two (2)
1
members shall serve for a term of three (3) years
commencing on the sffective date of this ordinance;
two (2} members shall serve for a term of two (2)
years commencing on the effective date of this ordinance;
and two (2) members sh all serve for a term of one (1)
year commencing from the effective date of this ordinance.
As the term of a member expires, the council shall
appoint a successor for a term of three (3) years ,
except as provided below. °'
" (c) Ex officio member. The mayor or a councilman
designated by the mayor shall serve as an ex officio
member of the park board and shall maintain liaison with
the city council and city manager, but shall not have a
vote in the decisions of the park board. "
" (d) Tenure. Members of the park board shall
serve at the pleasure of the city council. "
" (e) Vacancy. If a vacancy occurs on the park
board, the council shall fill the vacancy by appointing
a new member to serve the balance of the unexpired term. "
"Sec. 20-17. Meetings; bylaws .
The park board shall have regular meetings edery
three (3) months and special meetings as often as they
are required. The park board shall adopt bylaws to
govern the conduct of its business. "
"Sec. 20-18. Officers .
The park board shall meet each year between the
first day of May and the fifteenth day of May and elect
a chairman, vice-chairman and a secretary to serve a
term of one (1) year. "

"Sec. 20-19 . Powers and duties .
(a) The park board shall act in an advisory
capacity to the city council in the acquisition,
construction, dedelopment, operation, maintenance, or
improvement of, or addition to a city park. The
park board may meet, confer, or negotiate with any
individual, partnership, association, corporation,
or local, state or federal agent or governmental
organization. The park board may present a proposed
plan or design to the city council or city manager
for implementation or approval or adoption by
ordinance where necessary, as provided by law. '°
" (b) The city council shall notify the park board
of a meeting at which major construction, acquisition,
development, operation, maintenance or improvement of,
or addition to a city park is to be discussed in detail .
The city council or city manager shall relay to the
park board as soon as practicable, material information
pertaining to a city park facility . "
" (c) The park board shall report the condition of
park acquisition, development, construction, operation,
maintenanCe or improvement, to the city council the
first week of February, May, August and November of
each year, or more frequently, if requested by the
council. "
" (d) The board may submit to the council, in the
manner provided by law, a petition for the calling of a
special election or the proposition as to whether or
not bonds shall be issued for the acquisition, expansion,
construction, improvement, maintenance, or operation of

"Sec. 20-20 . Park budget.
The park board may, on or before the fifteenth
day of May of each year, submit to the city council
for approval, a budget for park facilities, setting
forth the expeCted income and expenditures for the
following fiscal year. "
SECTION 3. If any section, subsection, sentence, ,clause,
phrase or portion of this ordinana� is for any reason held invalid
or ur�constitutional by any Court of competent jurisdiction,
such portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining portions hereof.
SECTION 4. It is the intention of the governing body
and it is hereby ordained that the provisions of this ordinance
shall become and be made a part of the Code of Ordinances, City
of Cape Girardeau, Missouri, and the sections of this Code may
be renumbered to accomplish such intention.
SECTION 5 . This ordinance shall be in full force and
effect ten days after its passage and approval.
