AN ORDINANCE REAFFIRMING ACTION OF THE CITY COUNCIL TAKEN IN CITY
MANAGER FORM ORDINANCE NO. 668 OF THE NECESSITY TO CONDEMN CERTAIN
DEFECTIVE SIDEWALKS AND GIVING NOTICE TO PROPERTY OWNERS OF CONDEM-
NATION OF DEFECTIVE 5IDEWALK5 IN THE CITY OF CAPE GIRARDEAU, MISSOURI,
ON PACIFIC STREET, BROADWAY TO WATKINS DRIVE, ON BOTH SIDES OF STREET,
AND PROVIDING FOR THE REMOVAL OF SAID SIDEWALKS AND THE CONSTRUCTION
OF NEW SIDEWALK5 IN PLACE OF 5AID SIDEWALKS SO CONDEMNED AND REMOVED;
AUTHORIZING THE TAKING OF BID5 AND ISSUANCE OF TAX BILLS

WHEREAS, the City Council of the City of Cape Girardeau,
Missouri , in City Manager Form Ordinance No. 668 deemed it necessary
to condemn certain defective sidewalks and provided for giving
notice to property owners of condemnation of defective sidewalks in
the City of Cape Girardeau, Missouri, on Pacific Street, Broadway
to Watkins Drive, on both sides of street, providing for the removal
of said sidewalks and the construction of new sidewalks in the place
of said sidewalks so condemned and removed; and
WHEREAS, prescribed notice has been given to the property
owners whose property abuts on said defective sidewalks to remove
said defective sidewalks and construct new sidewalks, in accordance
with standard plans and specifications for sidewalk construction,
with'in thirty (30) days after receipt of such notice; and
WHEREAS, thirty (30) days time has expired since the giving
of said notice;
NOW, THEREFORE, BE IT ORDA.INED BY THE COUNGIL OF THE CITY
OF CAPE GIR.ARDEAU, MI5SOURI , AS FOLLOW5:
5ECTION l. The City Council of the City of Cape Girardeau,
Missouri, hereby reaffirms its action taken in City Manager Form
Ordinance No. 668, of the necessity to condemn certain defective
sidewalks in the City of Cape Girardeau, Missouri, on Pacific
Street, Broadway to Watkins Drive, on both sides of street, and
providing for the removal of said defective sidewalks and the
construction of new sidewalks in accordance with the standard plans
and specifications for sidewalk construction and with the applicable
statutes of the State of Missouri .
SECTION 2 . It is hereby ordered that publication for
advextisement of bids be made in accordance with applicable statutes

of the 5tate of Missouri and bids be taken for the removal of
and construction of sidewalks as set out in 5ection 1 r�f this
ordinance.
SECTION 3. That after bids are received and opened by the
City Council, the City Council shall let the contract for said work
to the lowest and best responsible bidder, and in case there are
no bids received, or that all bids are rejected for any reason, the
City Council may readvertise for bids for said work, or may order
and require the City Engineer or his designated representative to build
and construct said sidewalks or do other work as herein contemplated,
in accordance with the plans and specifications for the project.
SECTION 4 . 5pecial tax bills shall be issued for the cost
of constructing said sidewalks against the lot, tract, or parcel of
ground along which each of said sidewalks abut and such cost shall
become and be a lien against the property.
5ECTION 5. If any section, subsection, sentence, clause ,
phrase or portion of this ordinance is for any reason held invalid
or unconstitutional by any Court of competent jurisdiction, such
portion shall be deemed a separate , distinct and independent
provision and such holding shall not affect the validity of the
remaining portions hereof.
SECTION 6 . This ordinance shall be in full force and
effect ten days after its passage and approval.
