AN ORDINANCE DECLARING A NECESSITY FOR THE CITY OF CAPE
GIRARDEAU, MISSOURI, TO ACQUIRE, EITHER BY PURCHASE, GIFT
OR CONDEMNATION, LAND ALONG NEW MADRID STREET, BETWEEN
HENDER50N AVENUE AND ILLINOIS AVENUE, FOR 5TREET IMPROVEMENTS;
AUTHORIZING AND DIRECTING THE ACQUISITION OF LAND ALONG NEW
MADRID STREET, BETWEEN HENDERSON AVENUE AND ILLINOIS AVENUE,
FOR STREET IMPROVEMENT5, EITHER BY PURCHASE, GIFT OR CONDEM-
NATION; AUTHORIZING THE MAYOR TO EXECUTE ALL INSTRUMENTS AND
DOCUMENT5 NECE5SARY OR REQUIRED FOR THE ACQUI5ITION OF SAID
LAND, CONTAINING AN EMERGENCY CLAUSE
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE
CITY OF CAPE GIRARDEAU, MISSOURI , AS FOLLOW5:
5ECTION l. The City Council of the City of Cape
Girardeau, Missouri, does hexeby declare and find that a public
necessity exists for the acquisition by the City of Cape
Girardeau, Missouri, of land along New Madrid Street, between
Henderson Avenue and Illinois Avenue, for street improvements .
SECTION 2. It is hereby ordered that the City of Cape
Girardeau, Missouri shall acquire property along New Madrid
Street, between Henderson Averiue and Illinois Avenue, for street
improvements , said property and property rights to be acquired
being more particularly described as follows:
A temporary construction easement for placing
roadway fill and adjusting drainage over:
All of Lot One (1) in Block Fourteen (14)
of Normal Heights addition to the City of Cape
Girardeau, Missouri , as shown by plat recorded
in Plat Book 2 at Page 59
with all rights of the City forever to cease
upon completion of the construction of New
Madrid 5treet from Henderson Averiue to Illinois
Avenue.
SECTION 3. It is hereby ordered that the 1 and described
in 5ection 2 hereof shall be acquired by the City of Cape
Girardeau, Missouri, either by purchase, gift or, if in any
event said City is unable to agree with the owners of said
real estate as to the value thereof, then it is ordered that
condemnation proceedings be instituted in the name of the City

of Cape Girardeau, Missouri, in the proper court in order
to acquire said land by the exercise of the right of eminent
domain, in the manner as provided for in the laws of the
State of Missouri.
SECTION 4. The Mayor of the City of Cape Girardeau,
Missouri, is hereby authorized and directed to enter into on
behalf of said City any agreem.ent, contract, option or deed with
any person whatsoever in connection with the acquisition of
said interest in land for said City, and he is hereby authorized
to execute on behalf of and in the name of said City any
instrument or documerit which may be necessary in the acquisition
of said land.
5ECTION 5 . This Ordinance is neces:sary for the immediate
preservation of the public peace , health and safety and shall
go into effect immediately upon its passage and approval.
