AN ORDINANCE GRANTING A SPECIAL USE PERMIT TO MISSOURI CONFERENCE
ASSOCIATION C�F SEVENTH-DAY ADVENTISTS FOR PURPOSES OF CONSTRUCTING,
MAINTAINING AND OPERATING A GHURCH BUI_LDING, TO BE LOCATED ON PART
OF OUT LOT 45, U.5.P. SURVEY N0. 2199 , TOWNSHIP 30 NORTH, RANGE 14
EAST, CITY AN'D COUNTY OF CAPE GIRARDEAU, STATE OF MI5SOURI
WHER�A5, Missouri Conference Association of Seventh-day
Adventists i.s the owner of certain property in the City of Cape
Girardeau, Missouri on which it desires to construct, operate and
maintain a church building and related activities; and
WHEREAS, the proposed location of this church building
is between 828 and 700 South West End Boulevard Street in the
City of Cape Girardeau, Missouri; and
WHEREA5, the Zoning Code of the City of Cape Girardeau
requires that. a Special Use Permit be granted for such church
building.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE
CITY OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
SECTION l. The City Council, having duly considered
the applicati.on finds that the granting of the Special Use Permit
will not sub�tantially increase traffic hazards , conge�tion,
fire hazards ox' adversely affect the general character of the
neighborhood or the general welfare of the community nor will
it overtax public utilities or be in conflict with the
comprehensiv� plan.
SECTI:ON 2 . A Special Use Permit for the purpose of
constructing, maintaining and operating a church building and
related activities in Cape Girardeau, Missouri , on the following
described prc�perty:
A parcel of land containing 0 .918 of an acre,
more or less , located in Out Lot 45 , U.5 .P. Survey
No. 2199 , Township 30 IJorth, Range 14 East, City
and County of Cape Girardeau, Missouri , described
as fc�llows; Start at the point of intersection of
the center of West End Boulevard with the center of
Colle:ge 5treet, said point being the northwest corner
of said Outlot 45; thenCe 5outh 8° 0 ' West, along the
centE�r of West End Bouledard, 586 .47 feet; thence

South 82° 0 ' East 30 .0 feet to a point in the east
right of way line for the point of beginning: thence
continue 5outh 82° 0 ' East, 341 .26 feet for a corner;
thence 5outh 8° 0 ' West, 117. 33 feet for a corner:
thence North 82° 0 ' West, 341.26 feet for a corner
in the aforesaid east right of way line; thence
North 8° 0 ' East, along said east line, 117 .33 feet
to the point of beginning.
is hereby granted to Missouri Conference Association of
Seventh-day Adventists , to be effective ten days after the date
of passage and approval of this ordinance. The proposed special
use must comply with all regulations set forth in the Zoning
Code for the district in which the use is located except those
which have been specifically excepted under this permit, all
other applicable ordinances of the City of Cape Girardeau and
any special conditions contained in the 5pecial Use Permit, a
copy of which is attached hereto, marked as "Exhibit A" and
incorporated herein by reference. The Mayor is hereby given the
power to execute the Special Use Permit for and on behalf of the
City of Cape Girardeau, Missouri .
5ECTION 3 . This ordinance shall be in full force and
effect ten days after its passage and approval.

Missouri Conference Association of Seventh-day Adventists
is hereby granted a Special Use Permit for the �urpose of con-
structing, maintaining and operating a church building and related
activities in the City of Cape Girardeau, Missouri , on the
following described property for a period of indefinite years .
A parcel of land containinq � .918 of an acre ,
more or less, located in Out Lot 45 , U.S .P. Survey
No. 2199 , Township 30 Dlorth, Range 14 East, City
and County of Cape Girardeau, Missouri , described
as follows: Start at the point of intersection of
the center of Tr7est End Boulevard with the center
of College Street, said point heing the northwest
corner of said Out Lot 45; thence South 8° 0 ° West,
along the center of ta�st End Boulevard, 586 . 47 feeti
thence South 82° 0 ' East 30 .0 feet to a point in the
east right of way line for the point of beginning;
thence continue South 82° 0 ' East , 341. 26 feet for a
corner; thence South 8° 0 ' West, 117. 33 feet for a
corner; thence North 82° 0 ' West, 341. 26 feet for a
corner in the aforesaid east right of wa� line;
thence North 8° 0 ' East, along said East line ,
117 . 33 feet to the point of beginning.
The Special Use Permit granted upon the condition that
the Applicants be bound by all City Ordinances �ahich pertain to
said Special Use Permit and that the Applicants be bound
by the following conditions which are imposed as a condition
of issuance of this Special Use Permit. Upon the failure of
Applicants to compl:y with these special conditions , the Special
Use Permit will automatically terminate with the right of the City
of Cape Girardeau to enter upon the lan�. to ak�ate such special
use.
SPECIAL CONDITIONS:
1. Use restricted to church building anc� related
activities .

Th'is Special Use Permit shall be binding upon the
successors and assigns of Missouri Conference Association of
Seventh-day Adventists .

the City of Cape Girardeau, a municipal corparation of the
5tate of Missouri , and that the seal affixed to the foregoing
instrument is the seal of the said City and that the said
instrument was signed and sealed in behalf of said City by
authority of its City Council and acknowledged said instrument
to be the free act and deed of said City .
