CITY MANAGER FORM ORDINANCE N0. '7�
AN ORDINANCE GRANTING A SPECIAL USE PERMIT TO JOHN WELCH AND
MARY WELCH FOR PURPOSES OF PARKING A MOBTLE HOME, TO BE LOCATED
ON A PART OF LOT l, OF A SUBDIVISION OF 400 ARPEN5, KNOWN AS THE
RODNEY TRACT, IN U.S.P. 5URVEY NO. 21.99 , T. 30 N. , R. 13 E. , CITY
AND COUIVTY OF CAPE GIRARDEAU, STATE OF MIS50URI
WHEREAS, John Welch and Mary Welch are the owners of
certain property in the City of Cape Girardeau, Missouri,_ on which
they desire to park a mobile home to be used as a residence for
Mary Welch' s Mother; and
WHEREAS, the proposed location of this mobile home is
2707 Bloomfield in the City of Cape Girardeau, Missouri; and
WHEREAS, the Zoning Code of the City of Cape Girardeau
requires that a 5pecial Use Permit be granted for mobile home
parking;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF CAPE GIRARDEAU, MISSOURI, AS FOLLOW5:
SECTION 1. The City Council, having duly considered the
application finds that the granting of the Special Use Permit
will not substantially increase traffic hazards, Congestion, fire
hazards or adversely affect the general character of the neighborhood
or the general welfare of the community nor will it overtax public
utilities or be in conflict with the comprehensive plan.
SECTION 2. A Special Use Permit for the purpose of
parking a mobile home to be used as a residenCe for Mary Welch's
Mother in Cape Girardeau, Missouri, on the following described
property:
All that part of Lot One (1) of a Subdivision of
400 Arpens , known as the Rodney Tract, in U.S .P . 5urvey
No. 2199 , T. 30 N. , R. 13 E. , in the Gity and County
of Cape Girardeau, 5tate of Missauri, described as
follows: Begin at the point where the South line of
said Lot l, intersects the West right of way line of
U. S. Route 61; then�e N. 82 degrees 15' West, 948. 3
feet tor the point of beginning; thence continue North
82 degrees 15' West, 100. 5 feet; thence North 24 degrees
45 ' West, 241. 8 feet to a point in the south line of
Bloomfield Road; thence North 65 degrees 15 ' East
with said south line of Bloomfield Road 85. 0 feet;
thence 5outh 24 degrees 45' East, 295 .5 feet to the
point of beginning containing 0 .523 acres more or less .
is hereby granted to John Welch and Mary Welch, to be effective
ten days after the date of passage and approval of this ordinance.
The proposed special use must comply with all regulations set
forth in the Zoning Code for the district in whiCh the use is
located except those which have been specifiaally excepted under
this permit, all other applicable ordinances of the City of Cape
Girardeau an� any special conditions contained in the Special
Use Permit, a copy of which is attached hereto, marked as
"Exhibit A" and incorporated herein by reference. The Mayor is
hereby given the power to exeCute the Special Use Permit for and
on behalf of the City of Cape Girardeau, Missouri.
5ECTION 3. This ordinance shall be in full force and
effect ten days after its passage and approval.

This Special Use Permit grantec� upon the condition that
the Applicants be bound by all City Ordinances which pertain to
said Special Use Permit and that the Applicants be }aound by
the following conditions which are imposed as a condition of
issuanCe of this Special Use Permit. Ur�on the failure of Applicants
to comply with these special conditions , the 5pecial Use Permit
will automatically terminate with the right of the City of Cape
Girardeau to enter upon the land to ahate such special use.
BPECIA.L CONDITIONS:
l. 5pecial Use Permit nontransferable and use limited
to ].ife of_ Pnary T-�lelch` s Mother.
2 . Mobile Home must be twenty-five (25) feet off rear
property line.
3. Restricted to South fif ty (50) feet of property .
4. Restricted to the personal living quarters of
P�ary iae lch's Mother.

Special Use Permit
This 5pecial Use Permit shall be hinding upon the heirs,
successors and assigns of John �nlelch and n2ary �aelch.
