AN ORDINANCE GRANTING A SPECIAL USE PERMIT TO MI550URI UTILITIES
COMPANY AND/OR HONKER'S BOAT CLUB, INC. FOR PURPOSES OF PLACING,
UTILIZING AND MAINTAINING AN UNATTACHED MOBILE HOME FOR A RE5IDENT
CARETAKER OR WATCHMA.N AND CON5TRUCTING AND MA.INTAINING A STRUCTURE
FOR SANITARY FACILITIE5, TO BE LOCATED ON PART OF OUT LOT NO. 69 ,
CITY AND COUNTY OF CAPE GIRARDEAU, MISSOURI
WHEREAS, Missouri Utilities Company is the owner of certain
property in the City of Cape Girardeau, Missouri, on which Honker's
Boat C1ub, Inc, desires to place, utilize and maintain an unattached
mobile home for resident caretaker or watchman dwelling purposes
and construct and maintain a 20 x 20 foot concrete block structure
for sanitary facility purposes; and,
WHEREA5, the proposed location of the said mobile home and
structure is First 5treet, in the City of Cape Girardeau, which said
property is presently zoned Industrial; and,
WHEREAS, the Zoning Code of the City of Cape Girardeau
requires a 5pecial Use Permit be granted for a mobile home and sanitary
facility structure use in an Industrial District;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF CAPE GIRA.RDEAU, MI5SOURI, AS FOLLOWS:
SECTION 1. The City Council, having duly considered the
application finds that the granting of the Special Use Permit will
not substantially increase traffic hazards, congestion, fire hazards
or adversely affect the general character of the neighborhood or the
general welfare of the community, nor will it overtax public
utilities or be in conflict with the comprehensive plan.
SECTION 2. A Special Use Permit for the purpose of
placing, utilizing and maintaining an unattached mobile home for
resident caretaker or watchman dwelling purposes and constructing and
maintaining a concrete block structure for sanitary facility purposes
in the City of Cape Girardeau, Missouri, on the following described
property:
Part of Out Lot Number Sixty-nine (69) to the
City of Cape Girardeau, in Cape Girardeau County,
Missouri described by metes and bounds as follows :

Begin on the east right-of-way line of the
St. Louis-5an Francisco railroad right-of-way at a
point on the north line of the city limits of Cape
Girardeau as formerly estab lished, and run
northeastwardly along the east right-of-way line
of the 5t. Louis-San Francisco Railroad right-of-way
across said Outlot 69 for a distance of 600 feet;
thence east, parallel with the north corparate limits
of the City of Cape Girardeau as formerly established,
to the Mississippi River; thence, southwestwardly
along the bank of said river to the north corporate
limits of the City of Cape Girardeau, Missouri, as
formerly established; thence , west along the south
line of said Outlot 69 to the place of beginning and
containing approximately 5 acres .
is hereby granted to Missouri Utilities Company and/or Honker' s
Boat Club, Inc. , to be effective ten (10) days after the date of
passage and approval of this ordinance. The special use must
comply with all regulations set forth in the Zoning Code for the
district in which the use is located except those which have been
speCifically excepted under this permit, all other applicable ordi-
nances of the City of Cape Girardeau and any special conditions
contained in the Special Use Permit, a copy of which is attached
hereto, marked "Exhibit A" and incorporated herein by reference.
The Mayor is hereby given the power to execute the Special Use Permit
for and on behalf of the City of Cape Girardeau, Missauri .
SECTION 3 . This ordinance shall be in full force and effect
ten days after its passage and approval.

are hereby granted a Special Use Permit for the purposes of placing,
utilizing and maintaining an unattaChed single mobile home for
dwelling purposes for a caretaker and watchman and. Constructing and
maintaining a structure for sanitary facilities in the City of Cape

The Special Use Permit is granted upon the condi�ion that '
the Applicants be bound by a11 Cit�T Ordinances which pertain to the
Special Use Permit and that the Applicants �e bound by the following
conditions which are imposed as a condition of issuance of this
Special Use Permit. Upon the failure of the Applicants to comply
with these special. conditions , the Special Use Permit will
automatically terminate with the right of the Cityo uf Ca�?e Girardeau
to enter upon the land to abate such special use .
5PECIAL CONDITIONS :
l. Use is restricted to an unattached sinqle mobile home
to be used for the residence of a caretaker and
watchman only and only for such ti�e Honker 's Boat
Club , Inc. maintains a resident caretaker or watchman
- on the premises .
2 . Use restricted to Construction and maintenance of a
20 x 20 foot concrete block structure for sanitary
facilities ..
