AN ORDINANCE GRANTING A 5PECIAL USE PERMIT TO HELEN BOWMAN FOR
PURPO5E5 OF PLACING, UTILIZING AND MAINTAINING AN UNATTACHED
MOBILE HOME, TO BE LOCATED ON PART OF LOT 3, BLOCK 10 , ROBERTSON
GALE ADDITION, CITY AND COUNTY OF CAPE GIRARDEAU, MIS50URI
WHEREA5, Helen Bowman is the owner of certain property in
the City of Cape Girardeau, Missouri , on which she desires to place,
utilize and maintain an unattached mobile home for dwelling
purposes; and,
WHEREAS, the proposed location of the said mobile home is
1008 Rear North Spanish Street, in the City of Cape Girardeau,
which said property is presently zoned R-2; and,
WHEREAS, the Zoning Code of the City of Cape Girardeau
requires a Special Use Permit be granted for a mobile home use in
a Single-Family Dwelling District;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF CAPE GIRARDEAU, MI550URI, A5 FOLLOWS:
SECTION l. The City Council, having duly considered the
application finds that the grantinq of the 5pecial Use Permit will
not substantially increase traffic hazards, Congestion, fire hazards
or adversely affect the general character of the neighborhood or the
general welfare of the community, nor will it overtax public
utilities or be in conflict with the comprehensive plan.
SECTION 2. A 5pecial Use Permit for the purpose of
placing, utilizing and maintaining an unattached mobile home for
dwelling purposes in Cape Girardeau, Missouri, on the foll.owing
described property:
East 50 feet of Lot 3, Block 1.0 , Robertson
Gale Addition, City and County of Cape Girardeau,
Missouri
is hereby granted to Helen Bowman, to be effective ten (10) days
after the date of passage and approval of this ordinanCe. The
special use must comply with all regulations set forth in the Zoning
Code for the district in which the use is located except those
which have been specifically excepted under this permit, all other

applicable ordinances of the City of Cape Girardeau and any special
conditions contained in the Special Use Permit, a copy of which is
attached hereto, marked "Exhibit A" and incorporated herein by
reference. The Mayor is hereby given the power to execute the
Special Use Permi.t for and on behalf of the City of Cape Girardeau,
Missouri.
5ECTION 3. This ordinance shall be in full force and effect
ten days after its passage and approval.

Helen Bowman is hereby aranted a Special Use Permit for the
purposes of plaCing, utilizing and maintaining an unattached single
mobile home for dwelling purposes in the City of Cape Girardeau,
Missouri, on the following described �rorerty for an indefinite
period:
East 50 feet of Lot 3, 3].oCk 1.0 , Robertson
Gale Addition, City and County of Cape Girardeau,
Missouri
The 5peCial Use Permit is aranted upon the condition that
the Applicant be bound by all City Ordinances which pertain to the
Special Use Permit and t:�at the �ppliCant be bound by the following
conditions which are imposed as a condition of issuance of this
Special Use Permit . Upon the failure of the Applicant to comply
with these special conditions , the Special Use Permit will
automatically terminate with the right of the City of Cape Girardeau
to enter upon the land to abate such speCial use.
5PECIAL COiJDITIONS:
l. Use is restricted to an unattached single mobile home
to be used £or the residence of Helen Bowman only
and may not be rented, leased, or sold to others.
2 . Special. Use Permit not transferrable without consent
of the City Council .
3. 5peCial use shall meet all R-2 District zoning
regulations .
4 . Additions or modifications from original building
permit must be approved by the City Council.
5 . SpeCial use limited to lifetime of present owner,
Helen Bowman.
6. The house presently located on the premises shall be
torn down and removed before the m.obile home can be set
on the premises .

This Special Use Permit shall be binding upon the
administrators, heirs , successors , and assigns of Helen Bowman.
