AN ORDINANCE GRANTING A SPECIAL USE PERMIT TO OPAL A. WULFERS
AND STATE BOARD OF TRA.INING SCHOOLS, FOR PURPOSES OF MAINTAINING
AND OPERATING A STATE BOARDING HOME FOR JWENILES, TO BE LOCATED
ON PART OF LOT 36, BLOCK 6, RANGE "A" , CITY AND COUNTY OF CAPE
GIRARDEAU, MISSOURI
WHEREAS, Opal A. Wulfers is the owner of certain property
in the City of Cape Girardeau, Missouri , on which the 5tate Board
of Training Schools desires to operate and maintain a state boarding
home for juveniles and related activities; and,
WHEREAS, the proposed location of the said state boarding
home for juveniles facility is 143 South Frederick Street, in the
City of Cape Girardeau, which said property is presently zoned
C-3; and,
WHEREAS, the Zoning Code of the City of Cape Girardeau
requires a Special Use Permit be granted for a boarding home for
juveniles facility use in a Central Business District;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF CAPE GIRARDEAU, MI550URI, A5 FOLLOW5:
SECTION 1. The City Council, having duly considered the
application finds that the granting of the SpeCial Use Permit will
not substantially increase traffic hazards, congestion, fire hazards
or adversely affect the general character of the neighborhood or
the general welfare of the community, nor will it overtax public
utilities or be in conflict with the comprehensive plan.
SECTION 2. A 5pecial Use Permit for the purpose of
maintaining and operating a state boarding home for juveniles and
related activities in Cape Girardeau, Missouri, on the following
described property:
Sixty (60) feet off the Noxth side of Lot number
thirty six (36) Block numbex six (6) Range "A" in the
City of Cape Girardeau, Missouri, described as follows:
Begin at the Northeast corner of said lot number
thirty six (36) in Range "A" of said City and run
West with the North line of said lot one hundred and
eighty (180) feet to an alley; thence South with the
East line of said alley sixty (60) feet; thence
East parallel with William Street one hundred and
eighty (180) feet to Frederick Street; and thence
North with the West line of Frederick Street sixty (60)
feet to the point of beginning.

is hereby granted to Opal A. Wulfers and her heirs , executors ,
administrators or assigns; and State Board of Training Schools ,
to be effective ten (10) days after the date of passage and approval
of this ordinance. The special use must comply with all regulations
set forth in the Zoning Code for the district in which the use is
located except those which have been specifically excepted under
this permit, all other applicable ordinances of the City of Cape
Girardeau and any special conditions contained in the 5pecial Use
Permit, a copy of which is attached hereto, marked "Exhibit A"
and incorporated herein by reference. The Mayor is hereby given the
power to execute the 5pecial Use Permit for and on behalf of the
City of Cape Girardeau, Missouri .
SECTION 3. This ordinance shall be in full force and
effect ten days after its passage and approval.

Opal A. LVulfers and her heirs, eYecutors , administrators
or assigns, and 5tate Board of '�'raining, are hereby granted a
Special Use Permit for the purposes of maintaining and operating a
state boarding home for juveniles facility and related activities
in the City of Cape Girardeau, Missouri, on the following described
property for �n indefinite pt�riod:

the point of bec�inning.
The Special Use Permit is granted upc�n th�� condition that
the Applicants be bound by all City Ordinances �ahich pertain to
the Special Use Permit and that the Applicants be bound by the
following conditions whicl� are imposed as a conclition of issuance
of this 5pecial Use Permit. Upon the failure of the Applicants to
comply with these special conditions , the Special Use Permit will
automatically terminate with the right of the City of Cape Girardeau
to enter upon the land to abate such special use.

3. Special Use sha11 meet all C-3 District Zoning regulations .
4. Additions or modifications from origi,nal building
�ermi.t must be approvea by the City Council .

This Special Use Permit shall be binding upon the �
admi.nistrators, heirs, successors , and assigns of Opal A. Wulfers
and the State Board of Training Schools.
