AN ORDINANCE APPROVING THE FORM OF AN .ANi�NDMENT Td THE AGREEMENT
BETWEEN THE MISSOURI DEPARTMENT OF COMMUNITY AFFAIR5, THE SOUTHEAST
MISSOURI REGIONAL PLANNING COMMI5SION, AND THE CITY OF CAPE GIR.ARDEAU,
MISSOURI, RELP,TING TO AN EXTEN5ION OF TIME FOR COMPLETION OF AN
URBAN PLANNING CONTRACT, WITH AUTHORITY FOR THE MAYOR TO EXECUTE
WHEREA5, on the lst day of July, 1972, the Missouri
Department of Community Affairs, the Southeast Missouri Regional
Planning Commission, and the City of Cape Girardeau, Missouri,
entered into an Urban Planning Contract providing for an
extraterritorial zoning study; and
WHEREAS, the parties desire to amend this agreement to
provide for an extension of time for completion of the study;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
SECTION l. That the Amendment to Agreement by and between
the Missouri Department of Community Affairs and the Southeast
Missouri Regional Planning Commission and the City of Cape Girardeau,
Missouri, a copy of which is attached hereto marked "Exhibit A°'
is approved in form.
SECTION 2 . That the Mayor of the City of Cape Girardeau,
P�Iissouri, is hereby authorized and directed to execute this
Amendment to Agreement, attached hereto as "Exhibit A" , for and
on behalf of the City of Cape Girardeau.
SECTION 3 . This ordinance shall be in full force and
effect from and after ten days after its passage and approval.

This AMENDED AGREEM�NT , entered into this 18th day of JulY ,
1.973 , by and betwee� the Missouri Department of Communit"y Affairs ,
the Southeast Missouri Regi�nal Planning Commission , and the City
of Cape Girardeau , l�tissouri , witnesseth that :
WHEREAS the parties are desirous of amending their contract
dated July 1 , 1972 , by cxtending the date upon which a11 services
were to be performed under said contract dated July l , 1972 , for
a period of sixty-two (62) days ;
NOW THEREFORE , in consideration of the foregoing and of the
mutual covenants and agreements set forth , the parties hereto and
legally intending to be bound thereby , do covenant and agree for
themselv@s , their successors and assigns as folloias :
l . That Article XIII , "Time of Performance ," of the
referenced contract is hereby amended to delete
the words :
" . . . the expiration of twelve (12)
consecutive calendar months . . . "
and insert in lieu thereof the words :
" . . . the ex�iration of fourteen (14)
consecutive calendar months . . . "
2 . That all other pertinent references to the said amendment
contained in said contract dated July l , 1972 , shall be
acknowledged and cons.idered accordi.ngly .
