AN ORDINANCE ACCEPTING A 5PECIAL WARRANTY DEED FROM FRED A GROVES
AND ALLENE W. GROVES, FOR ALL OF LOT 5EVENTEEN (17) OF RANDOL
SECOND 5UBDIVI5ION AND OTHER PROPERTY, CITY AND COUNTY OF CAPE
GIRARDEAU, STATE OF MISSOURI, FOR PARK PURPOSES
WHEREAS, Fred A. Groves and Allene W. Groves have executed
a Special Warranty Deed, conveying to the City of Cape Girardeau
all of Lot 5eventeen (17) of Randol 5econd 5ubdivision and other
property, in the City and County of Cape Girardeau, Missouri, as
more fully described hereinafter in this ordinance, and the City
desires to accept such deed and have the same recorded;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF CAPE GIRARDEAU, MI550URI, AS FOLLOWS:
5ECTION l . The City of Cape Girardeau, Missouri, hereby
accepts a Special Warranty Deed executed by Fred A. Groves and
Allene �?'. Groves, conveying to the City of Cape Girardeau, Missouri,
the following described real estate located in the City and County
of Cape Girardeau, Missouri:
All of Lot 5eventeen (17) in Ran.dol 5econd
5ubdivision to the City of Cape Girardeau;
And also the following described premises:
Start at the Northeast corner of Lot Seventeen (17)
of Randol Second Subdivision; thence North 57° 37'
West 69 . 8 feet for a point of beginning; thence
North 76° 57' West 160 . 5 feet; thence North 0° 55 '
East 189 .9 feet; thenCe South 34° 10 ' East 273. 2
feet to the point of beginning; subject to existing
easements of record and subjeCt to taxes for the
year 1973; and subject to existing easements for
utilities, telephone lines and sewer lines.
SECTION 2 . It is ordered by the Council of the City of Cape
Girardeau that said deed be recorded by the City Clerk in the
Office of the Re�order of Deeds of Cape Girardeau County, Missouri .
SECTION 3. In accepting the Special Warranty Deed the
City herewith agrees as additional. consideration for the execution
and delivery hereof that the park be utilized as a public park
without buildings except for picnic and recreational shel.ters and
restroom facilities .

SECTION 4 . This ordinance shall be in full force and
effect ten days after its passage and approval.
