AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCE5 OF THE
CITY OF CAPE GIRA.RDEAU, MISSOURI, BY CHANGING THE �ONING OF PART
OF SURVEY N0. 812, TOWNSHIP 30 NORTH, RANGE 13 EA5T, CITY .AND
COUNTY OF CAPE GIRARDEAU, STATE OF MIS50URI ,
FROM M-2 TO R-2
WHEREAS, th� City Planning and Zoning Commission has
recommended that all the property described in Section 1 of this
ordinance should be rezoned from M-2 Heavy Industrial District to
R-2 5ingle-Family Dwelling District; and,
WHEREA5, Public Notice of such change was given as prescribed
in Chapter 30 of the Code of Ordinances of the City of Cape Girardeau,
Missouri, and public hearing was held on Wednesday, July 18, 1973;
and,
WHEREAS, the Council of the City of Cape Girardeau, Missouri,
has elected to rezone the property described in Section 1 from M-2
Heavy Industrial District to R-2 Single-Family Dwelling District;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF CAPE GIRA.RDEAU, MIS50URI, AS FOLLOWS:
5ECTIOiV l. Chapter 30 of the Code of Ordinances of the City
of Cape Girardeau, Missouri , is hereby amended to change the boundary
of the present R-2 Single-Family Dwelling District so as to include
the following described property:
Al1 of the East One Half of the 5outh One Half of a
traCt containing approximately one Acre in 5urvey No. 812
confirmed to John Saviour, alias Seavers, in Township 30
North, Range l3 East, in Cape Girardeau County, Missouri,
conveyed by Alfred Pieronett to Jacob 5helton by Deed
dated March 17, 1883, recorded in Book 14 at page 274 in
the Recorder's OF Cape Girardeau County, Missouri , and
conveyed also by Wm. D. Shelton devisee in the will of
William D. 5helton, to Leon Jones and Myra Jones by deed
dated April 26, 1923, Recorded in Book 77 at page l24 in
the Land records of Cape Girardeau County, Missouri , said
East one-half of said South One Half of said tract of
approximately One aCre being particularly described as
follows:
Begin at the northeast corner of a certain 36 . 45 acre
tract desaribed in a deed to William B. Wilson, dated
July 27, 1889 , and recorded in the Recorder's Office at
Jackson, Missouri , in book 21 at page 375, and run south
with the east line of said 36 .45 acre tract 480 feet for a
beginning point, thence west 62 .5 feet; thence south 160
feet to a Corner on the north line of Kingshighway; thence
east along the North line of Kingshighway, 62. 5 feet to a
corner on the east line of said 36. 45 acre tract; thence

north, along the east line of said 36. 45 acre tract
160 feet to the point of beginning; same being situate
on the north side of the Cape Girardeau and 5cott
County Public Road, also known as Kingshighway.
(Now known as South Sprigg Street)
Subject, however, to a road right-of-way 12 feet
wide off the west side of said tract, as per deed
recorded in Book 150 at page 458.
5ECTION 2. The City Council hereby finds and declares that
the property described in Section 1 hereof is at the present time
particularly suitable for the purposes and uses of R-2 Single-Family
Dwelling District, and that such changes authorized hereby are
reasonable and in reasonable conformity with the existing uses and
value of the immediately surrounding properties.
SECTION 3 . This ordinance shall be in full force and effect
ten days after its passage and approval.
