CITY MANAGER FORM ORDINANCE NO. 7�13
AN ORDINANCE ACCEPTING EASEMENTS FOR SEWERS IN SEWER DISTRICT NO.
14-J, IN THE CITY AND COUNTY OF CAPE GIRARDEAU, STATE OF MI550URI
WHEREA5, Harold J. Werner and Yvonne Werner, his wife;
Frank M. Casey and Wilma Casey, his wife; Joseph L. Mirgeaux, Dr.
and Dorothy Mirgeaux, his wife; James H. 5chwab and Mary 5chwab,
his wife; LaRoy R. Roper and L. Leone Roper, his wife; and Charles
N. Harris and Constance W. Harris, his wife, have executed easements
for sewers in Sewer District No. 14-J, conveying to the City of
Cape Girardeau, Missouri, land all in the City of Cape Girardeau,
Missouri, and all as more fully described hereinafter in the
ordinance, and the City desires to accept such easements and have
the same recorded;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF CAPE GIRARDEAU, MI550URI, AS FOLLOW5:
5ECTION l. The City of Cape Girardeau, Missouri, hereby
accepts easements for sewers, executed by Harold J . Werner and
Yvonne Werner, his wife; Frank M. Casey and Wilma Casey, his wife;
Joseph L. Mirgeaux, Dr. and Dorothy Mirgeaux, his wife; Jaznes H.
Schwab and Mary Schwab, his wife; LaRoy R. Roper and L. Leone Roper,
his wife; and Charles N. Harris and Constance W. Harris , his wife,
conveying to the City of Cape Girardeau, Missouri easements for sewers
in Sewer District No. 14-J on the f ollowing desCribed real estate
located in the City and County of Cape Girardeau, Missouri:
Part of Outlot No. 83, U. S. Private 5urvey No. 2199 ,
City and County of Cape Girardeau, 5tate of Missouri,
being a 10 foot wide strip of land lying 5 feet either
side of the following described center line: Begin at a
point on the east line of said Outlot No. 83, South 7°
44 ' West, 3,694. 2 feet along the east line of Outlot 78-B
and Outlot 83, from the northeast corner of Outlot 78-B,
and North 7° 44 ' East, 12Q .0 feet from the southeast corn.er
of a 9. 8 acre parcel of land as same is described in a
deed recorded in Book 272 at Page 104 of the land records
of Cape Girardeau County, Missouri; thence North 83° 15 '
West, 1, 788.9 feet to the east line of Mt. Auburn Road
and there terminating.

Begin at a point on the East line of Auburn Park
on the center line of Themis 5treet; thenCe South 83°
08 ' East, with the center line of Themis 5treet extended,
145 feet; thenCe South 62° 06 ' East, 40� .2 feet; thence
North 89° 32' East, 148. 3 feet to an existing sewer
manhole for Joint Sewer District No. 12-PP & 14-L in
Themis Street, extended West, and there terminating.�
SECTION 2. The easements hereby Conveyed as described in
Section 1 hereof are for the purpose of enabling the City, its agents,
servants and assigns, to install, lay, erect, construct, maintain,
operate and repair a certain sewer pipe or sewer main which is to be
placed in, on, upon, or across said property described, together
with all the useful, necessary and proper adjuncts, appurtenances,
manholes, and appliances in connection therewith.
SECTION 3 . This ordinance shall be in full force and effect
ten days after its passage and approval.
