AN ORDINANCE PROVIDING THA,T A PRIMARY ELECTION UNDER THE
PROVISIONS OF 5ECTION5 78. 470 TO 78.500, REVI5ED 5TATUTES
OF MI5SOURI, 1969 AS AMENDED, 5HALL NOT BE HELD
WHEREAS, there are vacancies for two members of the Council
of the City of Cape Girardeau and only three persons, namely
Howard C. Tooke, Jerry L. Reynolds and Pau1 H. Harty, Jr. , have
submitted their names as candidates for the vacancies in said
Council within the time requirements of Chapter 78, Revised
Statutes of Missouri, 1969 as amended, and it is therefore
unnecessary to hold a primary election;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE
CITY OF CAPE GIRARDEAU, MISSOURI , AS FOLLOW5:
SECTION l. A primary election under the provisions of
Sections 78. 470 to 78. 500 , Revised Statutes of Missouri, 1969
as amended, shall not be held as the City Clerk for Cape
Girardeau has within 48 hours after the expiration of the time
for filing statements of candidacy for the Council of the City
of Cape Girardeau, canvassed the statements and determined that
only three have been filed and that a primary election is thereby
unnecessary.
SECTION 2 . The names of the persons filing statements,
namely Howard C . Tooke, Jerry L. Reynolds and Paul H. Harty, Jr. ,
shall be printed on the general election ballots as the nomi.nees '�
for councilmen, in the order that they were filed with the City
Clerk, as provided for by Sections 78. 520 to 78. 540, Revised
Statutes of Missouri, 1969 as amended.
SECTION 3 . This ordinance is necessary for the immediate
preservation of the public peace, health and safety and shall go
into effect im�nediately upon its passage and approval.
