AN ORDINANCE REPEALING 5ECTION 5-25 OF THE CODE OF ORDINANCES
OF THE CZTY OF CAPE GIRARDEAU, MISSOURI, AND ENACTING A NEW
5ECTION IN LIEU THEREOF
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF
THE CITY OF CAPE GIRARDEAU, •MI5SOURI, AS FOLLOWS:
SECTION l. Section 5-25 of the Code of Ordinances
of the City of Cape Girardeau, Missouri, is hereby repealed.
5ECTION 2. That a new 5ection 5-25 of the Code of
Ordinances of the City of Cape Girardeau, Missouri, is
hereby enacted reading as follows:
"Sec. 5-25 . Qualifications of applicant.
No person shall be granted a license or
permit under this chapter unless such person
is of good moral character, and no person shall
be granted a license or permit hereunder whose
license as such dealer has been revoked, or
who has been convicted, since the ratification
of the Twenty-First Amendment to the Constitution
of the United 5tates , of a violation of the
provisions of any law applicalale to the
manufacture or sale of intoxicating liquor,
or who employs in his business as such dealer
any person whose license has been revoked or
who has been convicted of violating the
provisions of any such 1aw since the date
aforesaid; nor shall any corporation be granted
a license or permit hereunder unless the
managing officer of such corporation qualifies
as would an individual under the above applicable
requirements. "
SECTION 3. If any section, subsection, sentence,
clause, phrase or portion of this ordinance is for any
reason held invalid or unconstitutional by any Court of
competent jurisdiction, such portion shall be deemed a
separate, distinct and independent provision and such
holding shall not affect the valic�ity of the remaining
portions hereof.
SECTION 4 . This ordinance shall be in full force
and effect ten days after its passage and approval.
