AN ORDINANCE APPROVING THE FORM OF AN AIRPORT AND AIRPORT FACILITIES
AGREEMENT AND LEASE, SECOND AMENDMENT, BETWEEN THE CITY OF CAPE
GIRARDEAU, MISSOURI, AND AIR ILLINOIS, INC. , FOR TERMINAL BUILDING
SPACE AT THE CAPE GIRARDEAU MUNICIPAL AIRPORT, AUTHORIZING THE
MAYOR TO E�ECUTE
WHEREAS, the City of Cape Girardeau, Missouri and Air Illinois,
Inc. have heretofore entered into two agreements to lease certain
premises in the Terminal Building at the Cape Girardeau Municipal
Airport; and
WHEREAS, the said parties desire to further amend said
agreements by leasing additional space in said Terminal Building;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI, AS FOLLOWS :
SECTION 1. The "Airport and Airport Facilities Agreement
and Lease, Second Amendment" , copy attached hereto marked Exhibit
"A" , between the City of Cape Girardeau, Missouri and Air Illinois,
Inc. an Illinois Corporation, is approved as to form.
SECTION 2. The Mayor of the City of Cape Girardeau, Missouri,
is hereby authorized and directed to execute said agreement for
and on behalf of the City of Cape Girardeau, Missouri.
SECTION 3. This ordinance shall be in full force and effect
ten days after its passage and approval.

AIRPORT AND AIRPORT FACILITIES
AGREEMENT AND LEASE
Second Amendment
THIS AGREEMENT made and entered into this day of
December, 1978, by and between the City of Cape Girardeau, Missouri, •
a Municipal Corporation of the State of Missouri, hereinafter
called LESSOR, and Air Illinois, Inc. , a corporation organized
and existing under and by virtue of the laws of the State of
Illinois, and authorized to do business in the State of t�issouri,
hereinafter called LESSEE,
WITNESSETH:
WHEREAS, Lessor and Lessee have heretofore entered into two
(2) agreements : an agreement dated February 16, 1972, wherein
Lessor leased to Lessee certain premises at the Cape Girardeau
Municipal Airport, and an agreement dated April 1, 1972 which was
an amendment to the previous aqreement; and
WHEREAS, Lessor and Lessee now desire to further amend said
agreements by leasing additional space in the Cape Girardeau
Municipal Airport Terminal Building;
NOW, THEREFORE, in consideration of the rents, covenants and
mutual agreements contained herein, the parties hereto hereby
eovenant and agree as follows:
1. Article IX Paragraph One of the agreement dated February
16, 1972, as amended by the agreement dated April 1, 1972, is
hereby further amended as follows:
Paragraph One of Article IX, which reads as follows:
"Lessor hereby demises and leases to Lessee for a term
coextensive with the term of this agreement, the exclusive
use of an area ten (10) feet by sixteen (16) feet, approximately
One Hundred Sixty (160) square feet, for Lessee' s office,
ticket counter and baggage area which is a portion of the
space formerly occupied by Trans-Mo Airlines, Inc. in the

Terminal Building which is situated North of the main West
entrance, together with entrances thereto all of which is
shown on a plat attached hereto and marked Exhibit "1�" .
Lessee is to construct its own counter at its own expense in
accordance with requirements of the Airport Board. Lessee
agrees to pay the Lessor for the use of the premises, facilities,
rights, licenses, services and privileges granted hereunder,
a rental of Fifty-�hree Dollars ($53. 00) per month for the
exclusive use of that .space amounting to approximately One
Hundred Sixty (160) square feet described above, said rental
� to be paid in monthly installments at the end of each calendar
month. "
is hereby modified, changed and amended to read as follows:
"Lessor hereby leases to Lessee for a term coextensive
with the original term of said agreement and any renewals or
extensions thereof, the exclusive use of an area approximately
sixteen (16) feet by sixteen (16) feet, being approximately
two-hundred fifty-six (256) square feet in the Cape Girardeau
Airport Terminal Building, which is an area formerly occupied
by Trans-Mo Airlines, Inc. , together with all entrances
thereto, all of which is shown as the area bordered in red
on a plat attached hereto and marked Exhibit "A" , provided
that Lessor expressly reserves a right-of-way for ingress
and egress to the supply room used by the Airport Restaurant
over and through said leased premises on behalf of and for
the use and benefit of the owner and employees of the Airport
Restaurant. Lessee may use said premises for office area,
ticket counter and baggage area only. Lessee shall construct
its own counter at its own expense in accordance with the
requirements of the Airport Board. Lessee shall pay to
Lessor for the use of said premises the facilities, rights,

licenses, services and privileges, a rental of One Hundred
and Three Dollars ($103.00) per month, payable in monthly
installments at the end of each calendar month. "
2. It is further agreed that, except as hereinabove modified,
changed and amended, the terms, conditions and provi�ions of the
agreement dated February 16, 1972, shall apply to and shall �
govern, this amendment, and any and all further renewals or
extensions of said prior agreement.
IN WITNESS WHEREOF, the parties have hereunto executed this
agreement the day and year first above written.
