CITY MANAGER FORM ORDINANCE NO. 1 � �
AN ORDINANCE APPROVING THE TRANSFER OF THE CABLE T.V. FRANCHISE
FROM CAPE COUNTY CABLE T.V. , INC. TO CAPE GIRARDEAU CABLE
T.V. , A MISSOURI PARTNERSHIP
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
SECTION l. Pursuant to 5ection 31-22 of the Code of
Ordinances of the City of Cape Girardeau, Missouri, the Grantee' s
request to transfer the Cape County Cable T.V. , Inc. franchise
to Cape Girardeau Cable T.V. , a Missouri Pertnership, is hereby
approved and authorized.
SECTION 2. The Cape Girardeau Cab1e T.V. partnership
consists of the following general partners: Cape Girardeau
Cable T.V. , Inc. , Maurice Dunklin, Robert Earley, James Estes,
Jerry Estes, H. L. Jones, Harold Rapp, Cecil Tate, and Larry
Hudson.
SECTION 3. Cape Girardeau Cable T.V. is hereby substituted
for Cape County Cable T.V. , Inc. as the Grantee in the City
Manager Form Ordinance No. 1274, and is subject to all of the
provisions of said Ordinance.
SECTION 4 . If any section, subsection, sentence, clause,
phrase or portion of this ordinance is for any reason held invalid
or unconstitutional by any Court of competent jurisdiction,
such portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of
the remaining portions hereof.
SECTION 5. This ordinance shall be in full force and
effect ten days after its passage and approval.

ACCEPTANCE
Comes now Cape Girardeau Cable T.V. , a Missouri Partnership,
and agrees to assume all of the responsibility and liability
of the Grantee in Gity Manager Form Ordinance No. 1274, and
further accepts and agrees to be bound by all the terms and
provisions of City Manager Form Ordinance No. 1274, entitled:
AN ORDINANCE CREATING A NEW CHAPTER 31 OF THE
CODE OF ORDINANCES OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, GRANTING A FRANCHISE TO THE CAPE COUNTY
CABLE T.V. , INC. , ITS SUCCESSORS AND ASSIGNS,
TO OPERATE AND MAINTAIN A COMMUNITY ANTENNA
TELEVISION SYSTEM IN THE CITY; SETTING FORTH
CONDITIONS ACCOMPANYING THE GRANT OF FRANCHISE;
PROVIDING FOR CITY REGULATION AND USE OF THE
COMMUNITY ANTENNA TELEVISION SYSTEM; AND PRESCRIBING
PENALTIES FFOR VIOLATION OF THE FRANCHISE PROVISIONS.
