CITY MANAGER FORM ORDINANCE NO. / ��S�
AN ORDINANCE GRANTING A SPECIAL USE PERMIT TO JOHN L. E.
BOARDMAN AND EVELYN D. BOARDMAN FOR PURPOSES OF MAINTAINING
AND OPERATING A PRIVATE RESIDENCE AND ARCHITECT'S OFFICE,
TO BE LOCATED ON PART OF LOT 30, RANGE E, CITY AND COUNTY
OF CAPE GIRARDEAU, MISSOURI
WHEREAS , John L. E. Boardman and Evelyn D. Boardman,
his wife are the owners of certain property in the City of
Cape Girardeau, Missouri, on which they desire to maintain
and operate a private residence and architect's office; and
WHEREAS , the proposed location of the said residence
and architect's office is 615 Bellevue, in the City of Cape
Girardeau, Missouri, which said property is presently zoned
C-1, Local Commercial District; and
WHEREAS, a Special Use Permit is required for said
private residence and architect' s office use in a C-1 zone;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF
THE CITY OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
SECTION l. The City Council, having duly considered
the application finds that the granting of the Special Use
Permit will not substantially increase traffic hazards, congestion,
fire hazards or adversely affect the general character of
the neighborhood or the general welfare of the community,
nor will it overtax public utilities or be in conflict with
the comprehensive plan.
SECTION 2 . A Special Use Permit for the purposes
of maintaining and operating a private residence and architect' s
office, on the following described property:
The West 1/2 of the West 1/2 of Lot 30 , Range
E, City and County of Cape Girardeau, Missouri.
is hereby granted to John L. E. Boardman and Evelyn D. Boardman,
his wife to be effective ten (10) days after the date of
passage and approval of this ordinance. The Special Use
,
Permit must comply with all regulations set forth in the
Zoning Code for the district in wh'ich the use is located
except those which have been specifically excepted under
this permit, all other applicable ordinances of the City
of Cape Girardeau and any special conditions contained in
the Special Use Permit, a copy of which is attached hereto,
marked Exhibit "A" and incorporated herein by reference.
The Mayor is hereby given the power to execute the Special
Use Permit for and on behalf of the City of Cape Girardeau,
Missouri.
SECTION 3 . This ordinance shall be in full force
and effect ten days after its passage and approval.

are hereby granted a Special Use Permit for purposes of maintaining
and operating a private residence and architect's office
in the C+ity of Cape Girardeau, Missouri, on the following

described property for an indefinite period:
The West 1/2 of the West 1/2 of Lot 30, Range
E, City and County of Cape Girardeau, Missouri.
The Special Use Permit is granted upon the condition
that the Applicants be bound by all City Ordinarlces which
pertain to the Special Use Per�it and that the Applicants
be bound by the following conditions which a.re imposed as
a condition of issuance of this Special Use Permit. Upon
the failure of the Applicants to comply with. these special
conditions, the Special Use Permit will autamati.cally terminate
with the right of the City of Cape Girardeau to enter upon
the land to abate such special use.
SPECIAL CONDITIONS:
1. Use is restricted to maintaining and operating
a private residence and architer.t's office.
2. Special use shall meet all zoning regulations.
3. Additions or modification from original building
pernnit must be approved by the Gity Council.

This Special Use Permit shall be binding upon the
heirs, executors, successors and assigns of John L. E. Boardman

was signed and sealed in behalf of said City by autho�ity
of its City Council and acknowledged said instrument to be
the free act and deed of said City.

jurisdiction, such portion shall be deemed a separate, distinct
and independent provision and such holding shall not affect
the validity of the remaining portions hereof.
SECTION 3. It is the intention of the governing
body and it is hereby ordained that the provisions of this
ordinance shall become and be made a part of the Code of
Ordinances, City of Cape Girardeau, Missouri, and the sections
of this Code may be renumbered to accomplish such intention.
SECTION 4 . This ordinance shall be in full force
and effect ten days after its passage and approva
