HomeMy WebLinkAboutCityMgrForm.1353.07-19-1978 ' « R CITY MANAGER FORM ORDINANCE NO. �'� ��J AN ORD.INANCE REPEALING SECTION 5-5 OF THE CODE OF ORDINANCES OF THE CITY OF CAPE GIRA,RDEAU, MISSOURI, AND ENACTING A NEW SECTION 5-5 IN LIEU THEREOF REI�ATING T0 THE SALE OF ALCOHOLIC BEVERAGES BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU, MISSOURI , AS FOLLOWS: SECTION 1. Section 5-5 of the Code of Ordinances of the City of Cape Girardeau, Missouri, reading as follows: "Sec. 5-5 Sales to minors , habitual drunkards prohibited, exception; sales by minors prohibited. No person or his employees shall sell or supply intoxieating liquor or permit same to be sold or supplied to a habitual drunkard or to any person who is under or apparently under the influence of intoxicating liquor. Intoxicating liquor shall not be given, sold or otherwise supplied to any person under the age of twenty-one (21) years , but this shall not apply to the supplying of ,intoxicating liquor to a person under said age for medicinal purposes only, or by the parent or guardian of such person or to the administering of said intoxicating liquor to such person by a physician. No person under the age of twenty-one (21) years shall sell or assist � in the sale of dispensing of intoxicating liquors . " is hereby repealed in its entirety. SECTION 2 . A new Section 5-5 of the Code of Ordinances of the City of Cape Girardeau, Missouri, is hereby enacted, to read as follows: °Sec. 5-5. 5ales to minors, habitual drunkards prohibited, exception; sales by minors prohibited. No person or his employees shall sell or supply intoxicating liquor or permit same to be sold or supplied to a habitual drunkard or to any person who is under or apparently under the influence of intoxicating liquor. Intoxicating liquor shall not be given, sold or otherwise supplied to any person under the age of twenty-one (21) years, but this shall not apply to the supplying of intoxicating liquor to a person under said age for medicinal purposes only, or by the parerit or guardian of such person or to the administering of said intoxicating liquor to such person by a physician. No person under the age of twenty-one (21) years shall sell or assist in the sale of dispensing of intoxicating liquors except that, persons eighteen (18) years of age `or older may, when acting in the .. . , • , , . , . . . , capacity as a waiter or waitress , accept payment for or serve intoxicating liquor in places of business whi.ch sell food for consumption on the premises if at least fifty percent of all sales in those places consists of food; provided that nothing in th'is section shall authorize persons under twenty-one (211 years of age to mix or serve across the bar intoxicating beverages. " SECTION 3. If any section, subsection, sentence, clause, ,phrase or portion of this ordinance is for any reason held invalid or unconstitutional by any Court of competent jurisdiction, such portion sha11 be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions hereof.
