CITY MANAGER FORM ORDINANCE NO. I<��
AN ORDINANCE VACATING A PORTION OF UTILITY AND SEWER EASEMENTS
ADJACENT TO LOTS 21, 19 , 20 , 82 , 93, 94, 105, 83, 92 , 95 AND
104 , RIVERVIEW GARDENS SUBDIVISION, IN THE CITY OF CAPE GIRARDEAU,
MISSOURI
WHEREAS , the dedication and plat of Riverview Gardens,
a subdivision in the City of Cape Girardeau, Missouri, filed
February 26 , 1976, and recorded in the recorder`s office of
Cape Girardeau County, Missouri, in Plat Book 11 at Page 23
established easements for utilities and sewers as shown on
the plat of Riverview Gardens; and
WHEREAS , certain easements are not needed and are
unnecessary for any of the purposes for which they were established;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE
CITY OF CAPE GIRA.RDEAU, MISSOURI, AS FOLLOWS :
SECTION l. That portion of utility and sewer easements
in Riverview Gardens Subdivision, described as follows:
Ten feet along the Northwest 61.71 feet of Lot 21;
Ten feet along the Northeast 81 feet of Lot 19 ;
Ten feet along the Northeast 122.18 feet of Lot 20;
Five feet along the West 100 feet of Lot 82;
Five feet along the West 100 feet of Lot 93;
Five feet along the West 100 feet of Lot 94 ;
Five feet along the West 100 feet of Lot 105;
Five feet along the East 100 feet of Lot 83;
Five feet along the East l00 feet of Lot 92;
Five feet along the East 100 feet of Lot 95;
Five feet along the East 100 feet of Lot 104;
Except that no part of the East-West easement on
Lots 21, 82 , 83, 92 , 93, 94, 95, 104, and 105 be
vacated.
is not necessary or needed for any of the public purposes
for which it was established and is hereby vacated.
SECTION 2 . The Mayor of the City of Cape Girardeau,
Missouri, is hereby authorized and empowered to execute and
deliver quit claim deeds of the vacated portion of the land
described in Section 1 of this ordinance to the abutting property
owners.

5ECTSON 3. This ordinance shall be in full force
and effect ten days after its passage and approva .
