' f +1 v/. � J w` CITY MANAGER FORM ORDINANCE NO. �a g�� AN ORDINANCE CREATING A NEW ARTICLE V, SECTIONS 2-50 , 2-51, 2-52, 2-53 and 2-54 OF THE CODE OF ORDINANCE5 OF THE CITY OF CAPE GIRARDEAU, MISSOURI, ESTABLISHING A HOUSING ADVISORY BOARD BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS: SECTI(3N 1. Section 2-43 to and including Section 2-49 of the Code of Ordinances of the City of Cape Girardeau, Missouri, are hereby reserved. SECTION 2. A new Article V, Sections 2-50 , 2-51, 2-52, 2-53 and 2-54 of the Code of Ordinances of the City of Cape Girardeau, Missouri, are hereby created and enacted establishing a Housing Advisory Board, to read as follows : "ARTICLE V. HOUSING ADVISORY BOARD. Sec. 2-50. Created; membership. There is hereby created an advisory board consisting of five (5) citizens of the City of Cape Girardeau, Missouri, which shall be known and designated as the Cape Girardeau Housing Advisory Board. Al1 members of the Board shall serve without compensation. Sec. 2-51. Qualifications of inembers; terms , tenure; vacancy. a. Qualifications. A person appointed to the Cape Girardeau Housing Advisory Board shall be a taxpayer and qualified voter of the City. b. Terms. The City Council shall appoint by formal motion and majority action the first five (5) members of the Housing Advisory Board for terms as follows: two (2) members to serve for a term of three (3) years each commenc g on the effective date of this ordinance, two (2) �embers to serve terms of two (2) years each commencing on the effective date of this ordinance, and one (1) member to serve a term of one (1) year commencing on the effective date of this ordinance. As the term of a member expires , the City Council shall appoint a successor for a term of three (3) years. c. Tenure. Members of the Housing Advisory Board shall serve at the pleasure of the City Council. d. Vacancy. If a vacanvy occurs on the Housing Advisory Board, the City Council shall fill the vacancy by appointing a new member to serve the balance of the unexpired term. , ' , '„ ' �.� ., _ Sec. 2-52 . Meetings; bylaws. The Board shall organize within fifteen (15) days after its appointment and have regular meetings at least once each month and special meetings as often as the chairman feels is necessary to accomplish duties which are outlined in Section 2-54 of this ordinance. The Board may vote after the effective date of this ordinance to set a specific day of each month as a regular meeting date, i.e. second Monday of each month, and the date may then be changed upon proper notification to the City Council. The Board shall adopt bylaws to govern conduct of business . Sec. 2-53 . Officers. The Mayor shall designate which of the members appointed shall be the first chairman and he or she shall serve as chairman until one (l) year from the date of the first meeting of the Housing Advisory Board after the effective date of this ordinance. At th'is first meeting, the Board may elect �rom among its members a vice-chairman and a secretary, who also shall serve for one (l) year terms . The Board shall then meet annually between the first day of February and the fifteenth day of February to elect a chairman, vice-chairman and secretary to serve a term of one (1) year. The names of the new officers shall be reported to the City Council within fifteen (15) days after the election. Sec. 2-54 . Powers and duties. a. The Board shall act in an advisory capacity to the City Council to assess housing needs for low and moderate income persons , including Senior Citizens , and investigate Federal and State programs available for housing. b. The Board may conduct a volunteer survey or gather other information which its members feel is necessary to adequately assess housing needs �ar low and moderate income persons , including Senior Citizens . c. It will be the duty of the Board to analyze all information gathered in a volunteer survey or other means to determine if such housing needs exist, and if so, the extent of such housing needs. d. The Board shall investigate and study available Federal and State programs designed to assist in the glanning� development or redevelopment of housing to meet the needs of low and moderate income persons , including 5enior Citizens. e. The Board shall study and establish the merits and/or demerits of government financed or subsidized housing as compared to privately financed and managed housing programs, including both sale and low-rental properties. f. If applicable, the Board shall investigate ways and means of implementing solutions to any housing needs for the low and moderate income persons , including Senior Citizens . 2 . , _ ., ,.�, ' , -, ` . : - ��. _ , � :. 1 , , � . �. � . ,. ..� , g. The Housing Advisory Board shall keep the City Council informed of its activities and report the findings from its investigations and studies. " SEGTSON 3. It is the 'intention of the governing body and it is hereby ordained that the provisions of this ordinance shall become and be made a part of the Code of Ordinances of the City of Cape Girardeau, Missouri, and the sections of this Code may be renumbered to accomplish such intention. SECTION 4 . If any section, subsection, sentence, clause, phrase or portion of th'is ordinance is for any reason held invalid or unconstitutional by any Court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent pprovision and such holding shall not affect the validity of the remaining portions hereof. SECTION 5.
