AN ORDINANCE APPROVING THE FORM OF AN AGREEMENT BET6VEEN THE CITY
OF CAPE GIRARDEAU, MISSOURI, CAPE GIRARDEAU SCHOOL DISTRICT N0.
63, AND JACKSON EXCAVATING COMPANY, FOR CONSTRUCTION OF THE
MUNICIPAL SWIIIMING POOL BATHHOUSE AND RELATED ITEMS, AUTHORIZING
THE MAYOR TO EXECUTE, AUTHORIZING PAYMENT OF A SUM OF MONEY
T�lHEREAS, the City of Cape Girardeau, Missouri and Cape
Girardeau School District No. 63 are constructing a municipal
swimming pool; and '
WHEREAS, there is a need for construction of a 4800 square
foot bathhouse, general site work and grading, concrete pool
deck, sidewalk, as�halt surface parking lot, utilities, and
foundation and anchor placement for an air supported structure;
and
WHEREAS, Jackson Excavating Company desires to perform said
work and the said parties desire to enter into an agreement for
said construction;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
CAFE GIRARDEAU, MISSOURI, AS FOLLOV�S:
SECTION 1. The "Standard Form of Agreement Between Owner
and Contractor On the Basis of a Stipulated Sum" , copy attached
hereto marked Exhibit "A" , between the City of Cape Girardeau,

Missouri and Cape Girardeau School District No. 63 and Jackson
Excavating Company is approved as to form.
SECTION 2. The �Zayor of the City of Cape Girardeau, Missouri,
is hereby authorized and directed to execute said agreement, copy
attached hereto marked Exhibit '°A" , for and on behalf of the City
of Cape Girardeau, Missouri.
SECTION 3. Payment of a sum of money by the City of Cape
Girardeau, Missouri, is hereby authorized to be made to Jackson
Excavating Company for said construction work in accordance with
the terms and provisions of said Agreement.
SECTION 4. This ordinance shall be in full force and effect

ArNcle I. WORK. The C'ONTRAC'fORS shall perform all Work as spccified or indicated in the Contract Docu-
ments for the compl�tion of the Project gencrally dcscribed as follow�s:
Construction of a 4800 square ft. bathhouse, general site work and grading, concrete
pool deck, sidewalk, asphalt surface parking lot, utilities, and foundation and anchor
placement for an air supported structure.
Article 2. ENGINEER. The Project has been designc� by DELTA ENGINEERING CONSULTANTS, I�1C.

who will act as ENGINEER in connection with completion of the Project in accordance with the Contract Documents.

Article S. MISCELLANEOUS.
8.1. Terms uscd in this Agrcement which are dcfined in Articic 1 0( the General Conditions shall have the
meanings indicated in the General Conditions. •
8.2. Neithcr OWNER nor CONTRACTOR shall, without the prior written consent of the other, assign or
sublet in whole or in part his interest under any o! the Contrace Documents; and, specifically, CONTRACTOR shall
not assign any moneys due or to become due without thc prior written consent of OWNER.
8.3. OWNER and CONTRACTOR each binds himself, his partners, successors, assigns and legal representatives
to the other �arty hereto in respect to all covenants, agrecments and obligations comained in the Contract Documents.

A. Unit 02200 - Excavating, Gradinci and Filling:
Delete the following fro�n subparagraph 3.06 -{A) (2� , on page 5:

Delete the following fro�► subparagraph 2.02 (1) on page 4:

Delete Paragraph 3.15 CONCRETE SEALER on page 8 anc3 substitute:
All concrete floors, concrete pool deck, _and sidewalks shall receive

Company or approved equal.
The bathhouse concrete floors and concrete pool deck shall receive floor
hardner material Samseal by Master Builders Company. Application of
curing and hardner materials shall be according to manufacturer's
recommendations.

Delete the following from Paragraph 2.02 SLOTTED INSULATION BOARD on

Vent lines above the floor slab may be of copper instead of NO-HUB
cast iron.
