CITY MANAGER FORM ORDINANCE NO. ��
AN ORDINANCE REPEALING SECTIONS 7-3 (14) (15) OF THE CODE OF ORDINANCES
OF THE CITY OF CAPE GIRARDEAU, MISSOURI, RELATING TO THE BOCA
BASIC BUILDING CODE, 1978
WHEREAS, certain sections of the BOCA Basic Building Code
have been determined to be unnecessary and otherwise not useful
in the City' s Building Code Regulations; and
WHEREAS, those certain sections need to be repealed.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
SECTION l. Sections 7-3 (14) (15) of the Code of Ordinances
of the City of Cape Girardeau, Missouri, are hereby repealed in
their entirety.
SECTION 2. If any section, subsection, sentence, clause,
phrase or portion of this ordinance is for any reason held
invalid or unconstitutional by any Court of competent jurisdiction,
such portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining portions hereof.
SECTION 3. All prior ordinances or portions thereof which
are contrary to or inconsistent with the provisions of this
ordinance are hereby repealed to the extent of the contradiction
or inconsistency.
SECTION 4. It is the intention of the governing body and it
is hereby ordained that the provisions of this ordinance shall
become and be made a part of the Code of Ordinances of the City
of Cape Girardeau, Missouri, and the sections of this Code may be
renumbered to accomplish such intention.
SECTION 5. This ordinance shall be in full force and effect
ten days after its passage and approval.
