AN ORDINANCE REPEALING CITY MANAGER FORM ORDINANCE NOS. 1286 ,
1287, 1377 AND 1396 AND ENACTING IN LIEU THEREOF A NEGV ORDINANCE
RELATING TO MUNICIPAL ELECTION DAYS AND THE FORM AND TIME FOR
FILING FOR CITY COUNCILMEN
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
SECTION l. City Manager F`orm Ordinance No. 1286 , passed and
approved January 4, 1978 , City Manager Form Ordinance No. 1287 ,
passed and approved January 4 , 1979, City Manager Form Ordinance
No. 1377, passed and approved September 20, 1978 , and City Manager
Form Ordinance No. 1396 , passed and approved November 15 , 1978 ,
are hereby regealed in their entirety.
SECTION 2. The Code of Ordinances of the City of Cape
Girardeau, Missouri, is hereby amended by adding thereto the
following:
"Sec. 2-3 . Election Day.
All City elections shall be held on Tuesday. The City
general election day shall be the first Tuesday in April of
each year. The City primary election day, if required,
shall be the first Tuesday after the First Monday in March
of each year. Other city election days include those specified
by the Comprehensive Election Act of 1977 , Chapter 115, RSMo
1978 . " (State Law Reference, Section 115. 121 and 115. 123 ,
RSMo 1978)
SECTION 2. The Code of Ordinances of the City of Cape
Girardeau, Missouri, is hereby amended by adding thereto the
following:
"Sec. 2-4 . Statement of Candidacy - Time for Filing.
l. Any person desiring to become a candidate for councilman
shall file with the city clerk a statement of such
candidacy in substantially the following form:

COUNTY OF CAPE GIRARDEAU )
T , , being first duly sworn, say
that I reside at Street, City of Cape
Girardeau, County of Cape Girardeau, State of Missouri;
that I am a qualified voter therein; that I am a candidate
for nomination to the office of councilman to be voted
upon at the primary election to be held on the first
Tuesday, after the first Monday in March, 19 , and
am eligible therefor, and I hereby request that my name
be printed upon the official primary ballot for nomination
by primary election for such office, and that I will
serve as such officer, if elected.
Subscribed and sworn to (or affirmed) before me,
, on this day of , 19
2. No statement of candidacy for city councilman shall be
accepted for filing by the city clerk prior to 8 : 00
A.M. on the eleventh Tuesday immediately preceding the
city primary election day. No statement of candidacy
for city councilman shall be accepted for filing by
the city clerk after 4 : 30 p.m, on the seventh Tuesday
immediately preceding the city primary election day. "

SECTION 3. If any section, subsection, sentence, clause,
phrase or portion of this ordinance is for any reason held invalid
or unconstitutional by any Court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining portions hereof.
SECTION 4. It is the intention of the governing body and
it is hereby ordained that the provisions of this ordinance shall
become and be made a part of the Code of Ordinances, City of Cape
Girardeau, Missouri, and the sections of this Code may be renumbered
to accomplish such intention.
SECTION 5. When an ordinance repealing a former ordinance,
clause or provision, shall be itself repealed, such repeal shall
not be construed to revive such former ordinance, clause or
provision, unless it shall be expressly so provided.
SECTION 6 . This ordinance shall be in full force and effect
ten days after its passage and approval.
