AN ORDINANCE CONTRACTING WITH THE CITY OF
JACKSON, MISSOURI FOR AN INTERCHANGE OF
FIREFIGHTING SERVICES
WHEREAS, it is deemed desirable that a contract be entered
into for an interchange of service of the fire departments of
Jackson and Cape Girardeau, Missouri ; and
WHEREAS, Sections 71 . 370 to 71 . 390 , inclusive, of the
Revised Statutes of Missouri provide that municipalities may
contract and cooperate with each other for common services and
interchange of service of their fire departments.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF CAPF GIRARDEAU, MISSOURI , AS FOLLOWS:
SECTION 1 . The City of Cape Girardeau hereby contracts
with the City of Jackson for the interchange of service of the
fire departments of the parties upon the conditions and
provisions hereinafter contained.
''�' SECTION 2 . The fire department of the City of Cape
Girardeau, Missouri , shall respond to fire alarms on call from
the Chief , Assistant Chief or Captains in any part of the City
of Jackson, only to life or death , extreme emergency, or second
f_ ire alarm when the department is out fighting first alarm.
The fire department of Jackson shall respond to fire alarms on
call from the Chief, Assistant Chief or Captains in any part of
the City of Cape Girardeau, Missouri , only to life or death ,
extreme emergency, or second fire alarm when the department is
out fighting first fire alarm.
SECTIOPI 3 . This contract shall take effect and be in
force for five ( 5 ) years from and after the effective date of
this ordinance .
SECTION 4 . This contract may be terminated at any time
during its term on the passage of an ordinance to that effect
by the legislative body of either municipality and written
notice thereof given to the other party hereto by serving on
the City Clerk of such other municipality a certified copy of
such ordinance terminating this agreement . This termination
shall take effect sixty (60 ) days from the date of service of
such written notice .
SECTIOP� 5 . The consideration for the service of the fire
department of each municipality shall be the service given for
^, the protection of the lives and property in such municipality
by the service of the fire department of the other party
hereto, and no compensation shall accrue or be paid by either .....
party for the service of the fire departments of the other
party hereto.
SCCTION 6 . Neither municipality shall be liable to the
other for failure to respond to any call by the other
municipality, or for delay or negligence or mistake in
receiving or responding to any call, nor shall this contract be
interpreted as being an agreement for the benefit of any third
party.
SECTION 7 . Neither municipality shall be liable by reason
of this contract to any fireman, official or employee of the
other , nor shall any fireman , official or employee of either
municipality be considered for any purpose a fireman, official
or employee of the other .
SECTION 8 . In case of loss or damage to the equipment or
property of either municipality while responding to fire
alarms , such loss or damage shall be borne by the party owning
such equipment or property.
S�CTION 9 . In effectuating the purpose of this contract,
the parties hereto may maintain direct telephone lines between
the fire stations of each of them to be used exclusively for
fire calls . In such event, the expense of such lines shall be
shared equally by the parties hereto. `-''
SECTION 10 . This or. dinance shall be in full force and
effect upon the passage and approval of a like ordinance by the
City of Jackson but not sooner than ten days after its passage
and approval . 1
