AN ORDINANCE AUTHORIZING THE CITY MANAGER TO ENTER INTO
AN AMENDMENT TO THE THIRD SUPPLEMENTAL FEDERAL AID
URBAN PROGRAM AGREEMENT WHICH WOULD ALLOW THE
INDEPENDENCE STREET BRIDGE PROJECT TO BE FUNDED FROM
BRIDGE REPLACEMENT FUNDS RATHER THAN FEDERAL AID URBAN
FUNDS
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
SECTION l . The City Manager , on behalf of the City of Cape
Girardeau, Missouri, is authorized to enter into an amendment to
the Third Supplemental Federal Aid Urban Program Agreement. A
copy of this amendment is attached to this Ordinance and made a
part hereof .
°�' SECTION 2. This ordinance shall be in full force and effect
ten days after its passage and approval . �"j

AMENDMENT TO THE THIRD SUPPLEMENTAL
FEDERAL AID URBAN PROGRAM AGREEMENT
This Agreement, made and entered into by and between the
Missouri Highway and Transportation Commission, hereinafter called
"Commission", and the City of Cape Giraradeau, a municipal corporation in
the State of Missouri, hereinafter called "City"
WITNESSETH:
The parties hereto have previously made and entered into the
Third Supplemental Federal Aid Urban Program Agreement concerning a bridge
replacement project on Independence Street over Cape La Croix Creek. Said

Third Supplemental Federal Aid Urban Program Agreement is hereinafter
referred to as the "3rd Supplemental FAUP Agreement".
The City desires to use federal bridge replacement funds on the
improvement in the 3rd Supplemental FAUP Agreement. The Commission is
agreeable subject to the terms and conditions contained herein.
In consideration of the mutual covenants and promises contained
herein to be faithfully kept and performed by the parties hereto and each
of them, it is agreed as follows:
1. Federal bridge replacement funds up to the maximum Federal
share of 80% of costs may be used on the improvement designated as old
Project M-1505(001) and new Project BRM-1505(001) on the Federal Aid Urban
system in Cape Girardeau.

�►. 2. Except as modified, amended, or supplemented herein, the
3rd Supplemental FAUP Agreement between the parties hereto shail be and
remain in full force and effect.
3. This agreement is made and entered into subject to the
approval of the Federal Highway Administration.
IN WITNESS WHEREOF, the parties hereto have caused this
agreement to be executed by their respective officers and the City executes
same pursuant to Ordinance No. , of said City, approved on the
day of , 1985.
