AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE
OF ORDINANCES OF THE CITY OF CAPE GIRARDEAU,
MISSOURI , BY CHANGING THE ZONING OF PART OF
LOTS EIGHT AND NINE, MARGARET WALKER' S
SUBDIVISION, CITY AND COUNTY OF CAPE
GIRARDEAU, MISSOURI FROM R-1 TO C-1
WHEREAS, the City Planning and Zoning Commission has
recommended that all of the property described in Section 1 of
this ordinance should be rezoned from R-1 Single-Family
Dwelling District to C-1 , Local Commercial District; and
WHEREAS, Public Notice of such change was given as
prescribed in Chapter 30 of the Code of Ordinances of the City
of Cape Girardeau, Missouri , and public hearing was held on
Monday, September 16 , 1985;and
'"'�` WHEREAS, the City Council of the City of Cape Girardeau ,
Missouri , has elected to rezone the property described in
Section 1 from R-1 , Single-Family Dwelling District to C-1 ,
Local Commercial District;
NOW, THEREFORE, BE IT ORDAINED BY THE COUN�IL OF THE CITY
OF CAPE GIRARDEAU, MISSOURI , AS FOLLOWS:
SECTION 1 . Chapter 30 of the Code of Ordinances of the
City of Cape Girardeau , Missouri , is hereby amended to change
the zoning from the present R-1 , Single-Family Dwelling
District to C-1 , Local Commercial District, f�r the following
described property:
TRACT I :
Ti�at part of Lots Eight (8 ) and Nine ( 9 ) of Margaret
Walker 's Subdivision of Out Lot Sixty ( 60 ) of U .S.P .
Survey 2199 in the City of Cape Girardeau , County of
Cape Girardeau and State of Missouri described as
follows:
Commence at the intersection of the North line of
Broadway Street with the East line of Caruthers Avenue
in the City' of Cape Girardeau , Missouri ; thence North

8° East along the East line of Caruthers Avenue 150 �,
feet for a beginning corner ; thence North 8° East
along the East line of Caruthers Avenue 40 feet;
thence South 88° 07 ' East, 125 feet; thence South 8°
West, 40 feet ; thence North 88° 07 ' West parallel to
Broadway Street , 125 feet to the poin� of beginning.
TRACT II:
That part of Lots Eight (8 ) and Nine (9 ) of Margaret
Walker 's Subdivision of Out Lot Sixty ( 60 ) of U .S.P .
Survey 2199 in the City of Cape Girardeau , County of
Cape Girardeau, and State of Missouri , described as
follows: Commence at the intersection of the North
line of Broadway Street with the East line of
Caruthers Avenue in the City of Cape Girardeau ,
Missouri ; thence North 8° East along the East line of
Caruthers Avenue , 190 feet to a corner ; thence South
88° 07 ' East, 125 feet for a beginning corner ; thence
continue South 88° 07 ' East, 75 .0 feet to a corner ;
thence South 8° , 40 .0 feet; thence North 88° 07 ' West
parallel to Broadway Street , 75 .0 feet to a corner ,
thence North parallel to the East line of Caruthers
Avenue 40 .0 feet to the point of beginning, in the
County of Cape Girardeau and State of Missouri .
TRACT III :

Walker 's Subdivision of Out Lot Sixty (60 ) of U.S.P .
Survey 2199 in the City of Cape Girardeau , Missouri ,
described as follows: Commence at the intersection of
the North line of Broadway Street with the East line
of Caruthers Avenue in the City of Cape Girardeau ,
Missouri , thence North 8° East along the East line of
Caruthers Avenue 190 feet for a beginning corner ;
thence North 8° East along the East line of Caruthers
Avenue 50 feet; thence South 82° East 199 .2 feet, more
or less , to the Eastern line of a tract of land
conveyed by Nellie Colby Cherry to M. G. McCrate and
Charlotte C . McCrate on July 17 , 1950 , and recorded in
Book 148 at Page 165 ; thence South 8° West 29 feet,
more or less , to a point from which the Southeast
corner of the tract conveyed in Book 148 at Page 165
bears South 8° West 40 feet; thence North 88° 07 ' West
200 feet parallel with Broadway to the beginning
corner , EXCEPT the following real estate, described as
follows: That part of Lots Eight (8 ) and Nine (9 ) of
Margaret Walker 's Subdivision of Out Lot Sixty (60 ) of
U .S.P. Survey 2199 in the City of Cape Girardeau ,
Missouri , described as follows: Commence at the
intersection of the North line of Broadway Street with
the East line of Caruthers Avenue in the City of Cape
Girardeau , Missouri ; thence North 8° East alonq, the

feet, more or less , to a corner ; thence south 8° West
40 feet, more or less; thence North 88° 07 ' West 125
feet parallel with Broadway to the beginning corner ,
in the County of Cape Girardeau and State of Missouri .
SECTION 2 . The City Council hereby finds and declares that
the property described in Section 1 hereof is at the present
time particularly suitable for the purposes and uses of C-1 ,
Local Commercial District , and that such changes authorized
hereby are reasonable and in reasonable conformity with the
existing uses and value of the immediately surrounding
properties .
SECTION 3 . This ordinance shall be in full force and
effect ten days after its passage and approval .
