AN ORDINANCE ACCEPTING TEMPORARY
CONSTRUCTION EASEMENTS AND PERMANENT
CONSTRUCTION EASEMENTS IN CONNECTION WITH
THE INDEPENDENCE STREET BRIDGE PROJECT
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE
GIRARDEAU, MISSOURI , AS FOLLOWS:
SECTION 1 . The City of Cape Girardeau, Missouri , hereby
accepts the Temporary Construction Easement executed by Malan
Construction Company conveying a Temporary Construction
Easement to the City in the following described real estate
located in the City and County of Cape Girardeau , Missouri :
A temporary construction easement in the North
part of a tract of land as described in Book 301 at
Page 147 of the land records of Cape Girardeau County,
Missouri , under the name of Malan Construction
Company, more particularly described as follows :

Start at the Southwest corner of Outlot 81 of
U .S.P. Survey No . 2199 ; thence North along the line
between Outlots 81 and 82A, a distance of 689 .7 feet
to a point on the center line of Gordonville Road,
also designated as Route SK arid Independence Street ;
thence North 83° 55 ' East, along said center line a
distance of 786 . 5 feet , more or less , to Station 52 +
81 . 5 as shown on the Independence Street Bridge
Replacement plans on file in the Office of the City
Clerk of the City of Cape Girardeau, Missouri , which
point is also on the East line of an easement to the
Missouri State Highway Department as recorded in Book
120 at Page 319 ; thence in a Southerly direction,
along said East line and perpendicular to said center
line, a distance of 75 .5 feet to the point of
beginning; thence continue along said East line ,
perpendicular to said center line , a distance of 20 .0
feet; thence in an Easterly direction, parallel to
said center line , a distance of 53 .5 feet; thence in a
Northerly direction, perpendicular to said center

Easement to the City in the following described real estate
located in the City and County of Cape Girardeau , Missouri :
A permanent construction easement along the North
line of a tract of land as described in Book 301 at
Page 147 of the land records of Cape Girardeau County,
Missouri under the name of Malan Construction Company,
more particularly described as follows:
Start at the Southwest corner of Outlot 81 of
U.S.P. Survey No . 2199 ; thence North along the line
between Outlots 81 and 82A a distance of 689 .7 feet to
a point on the center line of Gordonville Road, also
designated as Route SK and as Independence Street;
thence South 83° 55 ' East along said center line a
distance of 786 .5 feet , more or less , to Station 52 +
81 .5 as shown on the Independence Street Bridge

Page 243 of the land records of Cape Girardeau County,
Missouri , under the name of Wiethop Truck Sales , Inc. ,
more particularly described as follows:
Start at the Southwest corner of Outlot 81 of
U .S.P. Survey No . 2199 ; tYience North along the line
between Outlots 81 and 82A a distance of 689 .7 feet to
a point on the center line of Gordonville Road, also
designated as Route SK and Independence Street; thence
South 83° 55 ' East along said center line a distance
of 894 . 2 feet , more or less , to the point of

Temporary Construction Easement to the City in the following
described real estate located in the City and County of Cape

Missouri , under the riame of General Sign Company, more
particularly described as follows:

U .S.P. Survey No . 2199 ; thence North along the line
between Outlots 81 and 82A, a distance of 689 .7 feet
to a point on the center line of Gordonville Road,
also designated as Route SK and Independence Street ;

Missouri , under the name of General Sign Company, more
particularly described as follows:
Start at the Southwest corner of Outlot 81 of
U .S,P. Survey No . 2199 ; thence North along the line
between Outlots 81 and 82A, a distance of 689 .7 feet
to a point on the center line of Gordonville Road ,
also designated as Route SK and Independence Street ;
thence South 83° 55 ' East along said center line a
distance of 801 .5 feet , more or Iess , to Station 52 +
96 .5 as shown on the Independence Street Bridge
