AN ORDINANCE ACCEPTING A SANITARY SEWER
EASEMENT IN ASHLAND HILLS ESTATES
SUBDIVIS ION� TN THE CITY AND COU1vTY OF CAPE
GIRARDEAU, MISSOURI
WHEREAS Donald P. Thomasson and Carolyn L, Thomasson , his
wife , have executed a sanitary sewer easement, conveying to the
City of Cape Girardeau, Missouri , land alit in the City of Cape
Girardeau and all as more fully descrik��-d hereinafter ic� the
ordinance, and the City desires to acce��t such easement and
have the same recorded ;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
SECTION 1 . The City of Cape Girardeau, i�ii �souri, hereby
accepts a sanitary sewer easement , executed by Donald P.
Thomasson and Carolyn L. Thomasson , his wife , conveying to the
City of Cape Girardeuu , Missouri , a sanitary sewer easement in
Ashland Hills Estates Subdivision , on the following described
real estate located in the City and County of Cape Girardeau ,
Missouri:
�° An easement for sanitary sewer purposes 15 feet in width
described as follows :
Start at the Northeast corner of Lot No . Five ( 5) of
Carolewood Estates Subdivision to the City of Cape
Girardeau; thence North 15° 05' West, 15 .0 feet ; thence
South 73° 50' West, 200. 28 feet ; thence South 5° 37 ' West ,
109.53 feet ; thence South 88° 28 ' Eas�, 15 .04 feet , to a
point on the west line of said Lot No . Five ( 5) ; thence
North 5° 37 ' East, 98 . 3 feet , to the northwest corner of
said Lot No. Five ( 5) ; thence North 73 ° 5G' East, 1fi9 . 83
feet, to the place of beginning situated in the North Half
of the Southeast 2uarter of Section 27, To�Ynship 31 North ,
Range 13 East.
and it is ordered that said easement be recorded in the Office
of the Recorder of Deeds of Cape Girardeau County, Missouri .
SECTION 2. The easement hereby conveyed as described in
Section 1 hereof is for the purpose of �nabling the City, its
agents , servants and assigns , to install , lay, erect ,
construct , maintain, operate and repair a certain sewer pipe or
sewer main which is to be placed in , on , upon , or across said
�
property described, together with all the useful , necessary and
proper adjuncts , appurtenances , manholes and appliances in ...
connection therewith .
SECTION 3. This ordinance shall be in full force and
effect ten days after its passage and approval .
