AN ORDINANCE ESTABLISHING A NEW ARTICLE III
OF CHAPTER 23 PERTAINING TO APPOINTMENT OF
SOUTHEAST MISSOURI STATE UNIVERSITY PUBLIC
SAFETY OFFICERS AS DEPUTY CITY POLICE
OFFICERS
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE
GIRARDEAU, MISSOURI, AS FOLLOWS:
SECTION 1 . A new Article III of Chapter 23 of the Code of
Ordinances of the City of Cape Girardeau, Missouri, is hereby
enacted to read as follows :
ARTICLE III . DEPUTIZATION OF SOUTHEAST MISSOURI
STATE UNIVERSITY PUBLIC SAFETY OFFICERS
Sec. 23-40. Power of Appointment.
The City Manager is authorized to appoint Southeast
Missouri State University Public Safety Officers as Deputy City
� Police Officers . Officers so appointed shall meet the
qualifications and shall have the powers set forth in this
Article .
Sec . 23-41 . Qualifications .
(a ) Southeast Missouri State University Public Safety
Officers appointed as Deputy City Police Officers must be
Missouri residents , twenty-one ( 21 ) years of age or older who
have successfully completed a course of basic training for
peace officers in a program approved and accredited by the
Director of the Missouri Department of Public Safety.
(b) Southeast Missouri State University Public Safety
Officers appointed as Deputy City Police Officers shall qualify
in the use of firearms semi-annually in accordance with
standards established by the Cape Girardeau Police Department .
Such officers may be required to participate in training
programs sponsored and provided by the Cape Girardeau Police
Department .
(c ) Recruitment and selection of Southeast Missouri State
University Public Safety Officers to be deputized by the City
as City Police Officers shall be based on minimum standards
approved by the City Manager .

,�^� Sec . 23-42. Arrest Power.
Any Southeast Missouri State University Public Safety
Officer appointed as Deputy City Police Officer shall have the
power to arrest on view and without warrant any person he sees
violating or who he has reasonable grounds to believe has
violated any law of the State of Missouri or any ordinance of
the City of Cape Girardeau .
Sec . 23-43. Supervision.
Southeast Missouri State University Public Safety Officers
appointed as Deputy City Police Officers shall be employees of
Southeast Missouri State University and shall routinely receive
direct supervision from their superiors in the Southeast
Missouri State University Department of Public Safety.
Sec . 23-44. Rules and Regulations .
The City Manager and the Chief of Police may issue rules
and regulations pertaining to Deputy City Police Officers .
Sec . 23-45 . Revocation of Deputization .
The City Manager may at any time and without prior
notification or hearing revoke the appointment of any Southeast
'� Missouri State University Public Safety Officer as a Deputy
City Police Officer . Except in extreme situations, however ,
the City Manager shall exercise this power only after
discussions with appropriate University Officials .
Sec . 23-46 . Insurance.
No Southeast Missouri State University Public Safety
Officer shall be appointed as Deputy City Police Officer unless
Southeast Missouri State University shall carry liability
insurance to cover the activities of all Public Safety Officers
deputized by the City in the minimum amount of $500, 000 . 00 each
person, $500, 000 . 00 each occurrence , $1 , 000, 000 . 00 annual
aggregate . Such insurance shall name the City of Cape
Girardeau and its officials and employees as insureds . The
City Manager shall revoke the appointments of all Southeast
Missouri State University Public Safety Officers as Deputy City
Police Officers if such insurance is not provided at all times
and evidence of such insurance provided to the City Manager .
SECTION 2. If any section, subsection, sentence , clause,
phrase or portion of this ordinance is for any reason held
invalid or unconstitutional by any court of competent
jurisdiction, such portion shall be deemed a separate, distinct
and independent provision and such holding shall not affect the
� validity of the remaining portions hereof .
�'"* SECTION 3. It is hereby declared an emergency exists as
provided for in Section 3 . 15 of the City Charter for the City
of Cape Girardeau, Missouri in that Southeast Missouri State
University public safety officers are no longer deputized by
the Cape Girardeau County Sheriff and the immediate
preservation of the public peace , property and safety requires
that Southeast Missouri State University public safety officers
have the power of arrest .
SECTION 4 . This ordinance shall be in full force and
effect from and after its passage and approval .
