AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE
OF ORDTN�NCES OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, BY CHANGING THE ZONING OF A PART
OF TRACT N0. 5 OF A PARTITION MADE FOR THE
KLAGES HEIRS IN OUT LOT 77 IN U. S. P. SURVEY
N0. 2199, CITY AND COUNTY OF CAPE GIRARDEAU,
MISSOURI, FROM R-1 TO C-2
WHEREAS, the City Planning and Zoning Commission has
recommended that all of the property described in Section 1 of
thi:> ordinance should be rezoned from R-1 , Single-Family
Dwelling District to C-2, General Commercial District ; and
WHEREaS, Public Notice of such change was given as
prescribe-;� by Chapter 30 of the Code of Ordinances of the City
of Cape Girardeau, Missouri , and public hear�.ng was held on
Wednesday, January 16, 1985 ; and
WHEREAS, the City Council of trie City of Cape Girardeau ,
Missouri , has elected to rezone the property described in
Section 1 from R-1 , Single-Family Dwelling District to C-2,
'^`' General Commercial District ;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF CAPE GIRARDEAU, MISSOURI , AS FOLLOWS:
SECTION 1 . Chapter 30 of the Code of Ordinances of the
City of Cape Girardeat� , f9issouri , is hereby amended to change
the zoning from th� present R-1 , Single-Family Dwelling
District to C-2, General Commercial District, for the following
described property :
A part of Tract Noa 5 of a partition made for the Klages
heirs in Out Lot 77 in U. S. P. Survey No. 2199, City of Cape
Girardeau, Cape Girardeau County, Missouri , described as
follows : Start at tt�e southwest corner of said Tract 5 ;
thence North 7° 04 ' East, along the line between Out Lots
77 and 78a , 350 . 0 feet to an intersection with the south
line of Thomas DL1v�e ; thence South 82° 56 ' East, along said
south line, 200 . 0 feet to an intersection with the east
line of Thomas Drive ; thence North 7° 04 ' East, along said
east line , 245. 0 feet for the point of beginning ; thence
continue North 7° 04 ' East, along said east line, 125 . 0
feet for a corner ; thence South 44° 30' East 190.1 feet to
the southwest corner of a service station lot ; thence North
85° 0' West 143 . 0 feet, more or less, to the point of
beginning. . �

SECTION 2. The City Council hereby finds and declares that
the property described in Section 1 hereof is at the present

time particularly suitable for the purposes and uses of C-2,
General Commercial District, and that such changes authorized
hereby are reasonable and in reasonable conformity with the
existing uses and value of the immediately surrounding
properties .
SECTION 3. This ordinance shall be in full force and
effect ten days after its passage and approval .
