AN ORDINANCE REPEALING CHAPTER 14 OF THE CZTY CODE
KNOWN AS THE GAS CODE AND ENAC�rING A NEW CHAPTER 14
TO BE KNOWN AS THE MECHANICAL CODE WHICH ADOPTS THE
BOCA BASIC NATIONAL MECHANICAL CODE%1984
WHEREAS, the City wishes to update and sta:�c]ardize its gas
code and adopt a comprehensive mechanical code , and
WHEREAS, the 1�84 Edition of the BOCA Basic r3ational
Mechanical Code, published by Building OfFicials and Code Ad-
ministrators International , Inc. , sets forth comprehensive
nationally recogni:ed regulations for the safe ir�stallation and
maintenance of inec`t�anical facilities including gas piping
systems ; and
WHEREAS, three ( 3) copies of the 1984 Editi.on of the BOCA
Basic National Mechanical Code have been on f.i.1.� with the City
Clerk for a period of ninety ( 90) days prior to tt�e adoption of
this ordinance,
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
'1 OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
SECTION 1 . Chapter 14 of. the Code of Ordinances c�f the
City of Cape Girardeau, Missouri, is hereby repealed in its
entirety.
SECTION 2. The City of Cape Girardeau t:ereby adopts the
1984 Edition of the BOCA Basic National Mechanical Code, pub-
lished by Building Officials and Code Administrators In-
ternational , Inc. , a copy of which is attached to this or-
dinance and incorporated herein by referen�e , as amended in
Section 3 of this ordinance.
SECTION 3. A new Chapter 14 of the Code of Ordinances of
the City of Cape Girardeau, Missouri , is herc�by enacted to read
as follows :
"Sec. 14-1 . Short Title .
This chapter shall be known as the "Mechanical Code of
the City of Cape Girardeau" and may be cited as such.
Sec. 14-2. Purpose .
The purpose of this chapter is to provid�� n�inimum
standards, provisions and requirements for tt; � safe in
�
stallation and maintenance of all mechanical equipment in
order to protect the public safety, health and welfare . �
Sec. 14-3. BOCA Basic National Mechanical Code/1984--
Adopted .
The City of Cape Girardeau hereby adopts the 1984
Edition of the BOCA Basic National Mechanical Code, pub-
lished by Building Officials and Code Administrators In-
ternational , Inc. , as amended in Section 14-4 of this
Code. Three ( 3) copies of the 1984 Edition of the BOCA
Basic National Mechanical Code are on file in the office of
the City Clerk and are available for public use, inspection
and examination.
Sec. 14-4. BOCA Basic National Mechanical Code/1984--
Amendments .
The BOCA Basic National Mechanical Code adopted by this
chapter is hereby modified and amended in the following
respects :
( 1 ) The following sections are hereby deleted :
(a) Section M-109.1 ,
(b) Section M-109. 2,

( f ) Section M-117. 4,

(k ) Article 20 in its entirety.
( 2) Section M-100. 1 on page 1 shall read as follows :
Title : This code shall be part of the Mechanical Code
of the City of Cape Girardeau hereinafter referred to
as the mechanical code or "this code. "
( 3) Section M-100. 2 on Page 1 is hereby modified, changed
and amended to read as follows : �.-

,�, Sco e : The design, installation, maint�nance, al-
teration and inspection of inechanical systems , ven-
tilating systems , cooling systems, stearn and hot water
heating systems , water heaters, process piping, gas
lines , �oilers and pressure vessels, appliances
utilizing gas, liquid or solid fuel , chimneys and
vents, mechanical refri�eration systems, fireplaces,
barbecues , incinerators, crematories and air pollution
systems as herein defined, shall comply with the re-
quirements of this code.
( 4) Section M-101 . 2 on page 1 is hereby modi£iec�, changed
and amended to read as follows :
Matters not provided for : Any requi�em�ents essential
for the safe operation of any appliance or �echanical
system not specifically provided for by this code
shall be determined by the mechanical o�ficial and
mechanical board.
( 5) A new Section M-109 .1 is hereby enacted to read as
follows :
Mechanical Official . The building official shall
serve as the mechanical official .
'� ( 6) Section M-111 .1 . 1 on Page 5 is hereby modified,
changed and amended by adding the following :
8 . 10 feet or less of single wall vent piping in-
stalled inside building .
( 7) Section M-122. 1 on page 11 is hereby modified, changed
and amended to read as follows :
Appeals : The owner of a building or structure or any
other person aggrieved may appeal to the Boar� of
Appeals established in Section 7-3 of the Code of Or-
dinances ot the City of Cape Girardeau, Missouri, a
decision of the mechanical officia]_ r�fusing to grant
a modification of the provisions of this Code covering
the manner of construction or materials to be used in
the erection, alteration or repair of a mechanical
system. Application for appeal may be made when it is
claimed that the true intent of this Code or the rules
legally adopted thereunder have been incorrectly in-
terpreted, that the provisions of this Code do not
fully apply, or that an equally good or better form of
construction can be used. The procedares set f�rth in
Section 7-3 shall govern such appealse
( 8) Section M-307 . 2 on page 34 is hereby modif.ied, changed

"M-307 . 2 Systems between 4 , 000 and 15, 000 cfm.

Air distribution systems with a capacity between 4, 000
and 15, 000 cfm shall be equipped with a heat detector
or approved smoke detector . "
( 9) Section M-507 .1 on page 46 is hereby modified, changed
and amended by adding the follocaing:
Automatic fire suppression systems shall only be in-
stalled by qualified persons certified by the manu-
facturer of the system they install . Proof of certi-
fication shall be presented upon request . All systems
are to be installed in accordance with NFPA 96 and the
specifications of the systems manufacturer .

the system they service . Proof of certification shall
be presented upon request . All systems are to be
serviced in accordance with NFPA 96 and the speci-
fications of the systems manufacturer .
Upon completion of servicing, a written statement
shall be presented as to what work was performed . Any
recommendations on changes needed to bring the system
up to NFPA standard 96 shall be noted on this state-

ment.
( 10) Table M-801 . 2 Fuel Gas Pipe on page 62 is hereby modi-
fied, changed and amended by excluding the following
materials :
(a ) Aluminum alloy pipe and tubing,
(b) Brass pipe,
(c ) Copper or copper alloy pipe,
(d) Copper or copper alloy tubing.
(11 ) Section M-803. 1 on page 65 is hereby modified, changed
and amended by adding the following:
(a ) Gas outlets for gas ranges and central heating
plants shall not be less than three-fourths ( 3/4 )
inch pipe and all other outlets shall not be less
than one-half (1/2) inch pipe.

( 12) Section M-812. 3 on page 77 is hereby modified, changed
and amended by adding the following:
A low-pressure air gauge may be substituted upon ap-
proval of the �nechanical official , in which case a
pressure of 20 pounds shall be sustain�d by the piping
for 20 minutes .
( 13) Section M-1216. 2 on page 99 is hereby modified,
changed and amended to read as follows :
M-1216 . 2. Automatic dampers : The in:�tallation of
dampers or stops on the vent pipe att�:ched to any ap-
pliance equzpped with a draft divertec is prot�ibited .
Sec. 14-5 . Liability of city.
This chapter shall not be construed as ' mposing upon the
city any liability or responsibility for d�.:�:ages to any
person injured by any defect in gas piping or appliances
mentioned herein, or by installation thereof, nor shall the
city or any official or empl�yee thereof be held as assum-
ing any liability or responsibility by reas�n of the
^'' ins�ec�ion authoxized hereund�r or certificate of: i.n-
spection isgued by the inspector .

Sec. 14. 6. Gas fitters board--Created ;
appointment, membership, term; .�;
qualifications ; powers .
(a ) Created ; appointment ; membership; term. There is
hereby created a gas fitters board. This board shall
consist of three ( 3) members who shall be appointed by
the mayor for a term of three years .
(b) Qualifications . Two ( 2) members of the board shall be
gas fitters who shall have had at least six ( 6) years
practical experience as gas fitters and be actually
engaged in or working at the trade of gas fitting at
the time of such appointment . They shall be citizens
of the United States , State of Missouri, and City of
Cape Girardeau, for at least five ( 5) years before
their appointment, and shall be actively engaged at
the trade or business of gas fitting for at least six
( 6) years .
(c ) Powers. The gas fitters board shall be consulted with
respect to all changes in this ordinance and their
recommendations shall be forwarded to the city council
for their consideration within sixty ( 60) days .
Sec. 14-7. Same - Meetings ; appointment and duties
of secretary.

(a ) Meetings . The board shall meet at least once every
three ( 3) months, or oftener if necessary, for the exami-
nation of any applicants for license as gas fitter , or to
hear and determine any charges made against any gas fitter ,
or for the transaction of any other business by the board.
(b) Secretary; appointment, duties . One of the members
shall be appointed as secretary of the board. He shall
keep a record of the proceedings and acts of the board. He
shall register , in a book to be kept by him for that pur-
pose, the name, residence and place of business of every
licensed person engaged in or working at the business of
gas fitting in the city.
Sec. 14-8. Gas fitters to register with board.
Any person who engages in or contracts for the business
of gas fitting in the city shall first register his name,
residence and place of business with the secretary of the
gas fitters board. Every such person shall promptly notify
the board of any change in his place oF business .

%� Sec. 14-9 . Examination for license or certificate--
Applic•ation.
Any person before engaging in or working at the instal-
lation, extension, alteration or repair of any gas ap-
pliances or piping pert.aining to or in cozzr.ection with gas
service on consumers ' premises within the city shall make
written application to the plumbing or gas fitl.ing in-
speckor and appear before the gas fitters board and there
take and pass an examination .
Sec. 14-10. Same--Requirements ; contents ; deposit
required ; reexamination .
(a ) Requirements ; contents . No person shall be entitled
to take such examination for a cer. tificate or license
as a gas fitter who has not had two i�ears ' practical
experience in the gas fitting trade as a helper or
apprentice. The applicant shall submit with nis ap-
plication proof of his two years ° practical
experience. The examination sha11" be cor�ducted wholly
or partly in writing or mechanical demonstration as
directed by the board.
(b) Deposit required . Each applicanc for cerL-ificaL-e as �
� gas fitter shall deposit with the application the sum
of three dollars (�3. 00) . If the applicant passes
such examination the deposit sha11 be cr�;:iteci upon
the certificate or license fee . If the ar�pl�cant
fails to pass the examination, ttle deposit shall be
retained by the city to pay the costs of conducting
such examination.
(c ) Reexamination . Shoul� the applicant fail to pass the
required examination, he shall not be eligible to be
reexamined within a period of ninety ( 90 ) days there-
after except �y special permission of the boarc?.
Sec. 14-11 . Same - Exemptions .
(a ) Gas fitters holding certificates . Any gas fitter
holding a valid certificate issued by a board of examiners
in any third class city of the state , which maintains such
board of gas fitting examiners , shall be recognized, regis-
tered and licensed in the city without reexamination, but
it shall be unlawful for any such person or any other
person to contract for or engage in any gas fitting work ii5
the city without first having obtained su4h a certificate
from the examining board of this city as above mentioned
and without registering and procuring a license as herein
provided.

subject to the provisions of this chapter governing permits
and inspection, but no such owner shall be permitted to �,
employ other than licensed gas fitters or licensed plumbers
in such gas fitting work .
(c ) Licensed journeyman plumbers , master plumbers. Any
qualified and licensed journeyman plumber or master plumber
may engage in the business of gas fitting without any ad-
ditional examination and under his license or certificate
as a journeyman plumber or a master plumber , as the case
may be. Any qualified and licensed journeyman plumber,
master plumber or gas fitter may apply, assemble , con-
struct, install , repair or maintain any material covered in
the BOCA Mechanical Code and may install any piping,
electrical wiring, duct work, and other hardware to make
the equipment installation complete and useable .
Sec. 14-12. License or certificate--Issuance upon
successful completion of examination .
Upon satisfactory proof of qualification and fitness, as
disclosed by the application and examination , a license or
certificate shall be issued by the board authorizing the
applicant to engage in or work at the trade of gas fitting
as a gas fitter.
Sec. 14-13. Same - Duration ; renewals ; fee .
�
(a ) Duration. All licenses or certificates issued
hereunder shall expire and be required to be renewed on or
before April first of each year . There shall be no re-
duction in the amount of fee or tax required to be paid for
such license or certificate regardless of the length of
time the same is issued prior to April first.
(b) Failure to renew. If any license or certificate is
not renewed within thirty ( 30) days following April first,
the holder thereof shall be required to take and pass
another examination by the gas fitters board.
(c ) Fee . The annual fee for a gas fitter is one dollar
($1 .00) which fee shall be paid to the city clerk at the
time of the issuance of such license or certificate, and at
the time of each renewal thereof . All licenses which are
not renewed by April first of each year shall be expired
and may thereafter be renewed only upon the payment of a
penalty of five dollars (�5. 00) ; provided , however , that if
the license is not renewed within thirty ( 30 ) days after
April first, said applicant shall, in addition to paying a
five dollar ($5. 00 ) penalty fee, be required to take and
pass another examination as required in subsection (b)
herein.

� Sec. 14-14. Same--Lending, false use oi prohibited ;
suspension or revocation.
No person shall lend his gas fitter 's or master
plumber ' s license to any other person , nor shall any such
licensed person apply for a permit in his name for use of
any other per:on , and any such licensed person so doing or
refusing to comply with any other requirements of this
chapter shall have his gas fitter ' s or master plumber ' s
license suspended or revoked by the city council .
Sec. 14-15 . InsDection fees ; payment.
(a ) Consumers ' piping. The fee for inspection of con-
sumers ' piping is one dollar ($1 . 0� ) for each outlet ;
for e�.ch reinspection or partial i�7spection, one
dollar ($1 .00 ) per outlet .
(b ) Conversion burners, floor furnaces , central heating
lp ants . The fee for inspecting conversion burners,
floor furnaces, or central heating plants is one
dollar ($1 .00) for each unit ; for each reinspection or
partial inspection one dollar ( $1 . 00 ) .
(c ) Used �ppliances . The fee for inspecting used ap-
pliances that are t�� be offered for sale is one dollar
^ ($1 . OQ) , and one dollar ($1 .00 ) for each additional
appliance .
(d ) Payment . Fees shall be paid by the person to whom the
permit is issued.
Sec. 14-16 . Discontinuarice of servic�e by gas company
for defective or dangerc�us piping and
appliances .
(a ) Discontinuance of service ; notic� re�uired . Pi'he gas
company may discontinue or refuse to �upply gas for
any gas piping or g�s appliance which appears to be
defective or leaking, or otherwis � considered to en-
danger life or property; provided it immediately gives
notice of discontinuance to the ir�spector and occupant
of the buildinc� or premises where suc�; gas supply is
discontinued or refused.
(b ) Resumption of service . In all cases where the
supplying of gas has been discontiriued for safety
reasons , the su�plying of gas sha13 not be re�umed
until authorized by the ins�ector .
Sec. 14-17 . Penalty for violati�n of pr�visions .
� (a ) First convich.ion . Any person wh� violates any �ro-
vision of this chapt�r upon conviction thereof shall be

subject to a fine in sum not less than five dollars ($5.00)
nor more than five hundred dollars (�500. 00) or to three `"
( 3) months imprisonment, or to both fine and imprisonment,
or the license of such person may be revoked, or both fine
and revocation of license may be imposed. Each day that a
violation continues shall be deerned a separate offense .
(b) Second conviction. A second conviction for viola-
tion of any provision of this chapter within one calendar
year shall in addition to the penalties above provided
cause the license and certificate of the person so con-
victed to be suspended or revoked for a period of six ( 6 )
months . "
SECTION 4. The repeal of Chapter 14 of the Code of Or-
dinances of the City of Cape Girardeau, Missouri , provided for
in Section 1 of this ordinance shall not affect the validity of
any permits granted thereunder and shall not affect any offense
or act committed or done or any penalty or forfeiture incurred
before the effective date of this ordinance.
SECTION 6. If any section , subsection, sentence , clause,
phrase or portion of this ordinance is for any reason held in-
valid or unconstitutional by any Court of competent juris-
diction, such portion shall be deemed a separate, distinct and
independent provision and such holding shall not affect the
�� validity of the remaining portions hereof. �
SECTION 5. This ordinance shall be in full force and
effect ten days after its passage and approval .
