AN ORDINANCE AMENDING CHAPTER 21 OF THE CITY CODE BY ADOPTING THE BOCA BASIC NATIONAL PLLMBING CODE/1984 WHEREAS, the City wishes to update and �tandardize its code provisions pertaining to plumbing; and WHEREAS, the 1984 Edition of the BO�A Basic National Plumbing Code published by Building O�ficials and Code Administrators International , Inc. contains current nationally recoqnized standards for plumbing; and WHEREAS, three ( 3) copies of the 1984 Edition of the BOCA Basic National Plumbing Code have been on file with the City Clerk for a period of ninety ( 90) days prior to the adoption of this ordinance, NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS: SECTION 1 . Section 21-3 of the Code of Ordinances of the �"� City of Cape Girardeau, Missouri, is hereby repealed . SECTION 2. The City of Cape Girardeau hereby adopts the 1984 Edition of the BOCA Basic National Plumbing Code, published by Building Officials and Code Administrators International , Inc . , a copy of which is attached to this ardinance and incorporated herein by reference , as amended in Section 3 of this ordinance. SECTION 3. Chapter 21 of the Code of Ordinances of the City of Cape Girardeau, Missouri , is hereby amended by adding the following: "Sec. 21-3. The BOCA Basic National Plumbing Code/1984 Adopted . The City of Cape Girardeau hereby adopts the 1984 Edition of the BOCA Basic National �lumbing Code published by Building Officials and Code Administrators International , Inc. as amended in Section 21-4 of this Code . Three ( 3) copies of the 1934 Edition of the BOCA � Basic National Plumbing Code are on file in the Office of the City Clerk and are available for public use, inspection, and examination. `-' Sec. 21-4. BOCA Basic National Plumbing Code/1984 Amendments . The BOCA Basic National Plumbing Code adopted by this chapter is hereby modified and amended in the following respects : (a ) Section P-100. 1 is amended to read as follows : Title: These regulations shall be part of the Plumbing Code of the City of Cape Girardeau, Missouri hereinafter referred to, as "this code. " (b ) Section P-104 . 1 on page 6 is amended to read as follows : Continuation : The legal use and occupancy of any structure existing on the date this code is adopted, or for which it had been heretofore approved, may be continued without change except as may be specifically covered in this code or deemed necessary by the plumbing official for the general safety and welfare of the occupants and the public . � (c) A new Section P-109.1 is hereby enacted to read as follows : Plumbing Official : The building official shall serve as the plumbing official . (d) Section P-109 . 2 is hereby deleted. (e) Section P-114. 2 is hereby deleted . ( f ) Section P-117 . 4 is hereby deleted . (g) Section P-118. 2 is hereby deleted . (h ) Section P-122. 1 is amended to read as follows : Appeals : The owner of a building or structure or any other person aggrieved may bring before the Board of Appeals established in Section 7-3 of the Code of Ordinances of the City of Cape Girardeau, Missouri , a decision of the Plumbing Official refusing to grant a modification of the provisions of this Code covering the manner of construction or materials to be used in the erection , alteration or repair of a plumbing system. Application for appeal may be made when it is �...� -2- /�. claimed that the true intent of this Code or the rules legally adopted thereunder have been incorrectly interpreted, the provisions of this Cr��e do not fully apply, or any duly good or better form of construction can be used. The procedures set forth in Section 7-3 shall govern such appeals . (i ) Sections P-122.1 . 2 through P-122. 4 are hereby deleted . ( j ) Section P-303. 2 is amended to read as follows : Public systems available: A public water main or public sewer system shall be considered available to a building when the building is located upon property which is within two hundred ( 200) feet of a public water main or sewer. (k ) Section P-308 . 3 is amended to read as follows : Freezing: Plumbing piping in exterior building walls or areas subjected to freezing temperatures shall be adequately protected against freezir;g by insulation or heat or both . (1 ) Table P-404 . 1 . 3, Wat�r Distribution Pipe , is amended by deleting chlorinated polyvinyl chloride ( CPVC) '� plastic pipe and tubing and polybutylene ( PB) plastic piping and tubing from the material list . (m) Section P-I804 . 0, Engineered Vent System, is deleted in its entirety. Sec. 21-5. Conflicting Provisions . Where the provisions of the 1984 Edition of the BOCA Basic National Plumbing Code are in conflict with the provisions of the Code of Ordinances of the City of Cape Girardeau , the pro�visions of the Code of Ordinances shall prevail . Sec. 21-6. Penalties . Any person who shall violate a provision of the 1984 Edition of the BOCA Basic National Plumbing Code or shall fail to comply with any of the requirementa thereof shall be guilty of an offense punishable by a fine of not more than Five Hundred Dollars or by imprisonment not exceeding ninety ( 90) days or by both such fine and imprisonment . Each day that a violation continues shall be deemed a separate offense. " SECTION 4. The repeal of Section 21-3 of the Code of ''� Or�inances of the City of Cape Girardeau, Miss�uri , provided -3- for in Section 1 of this ordinance shall not affect the validity of any permits granted thereunder and shall not affect ,� any offense or act committed or done or any penalty or forfeiture incurred before the effective date of this ordinance . SECTION 5. If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional by any Court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions hereof. SECTION 6. This ordinance shall be in full force and effect ten days after its passage and approval .
