AN ORDINANCE REPEALING A PORTION OF CHAPTER 11
OF THE CITY CODE PERTAINING TO FIRE PREVENTION
AND ADOPTING THE BOCA BASIC/NATIONAL FIRE
PREVENTION CODE/1984
WHEREAS, the City wishes to update and standardize its code
provisions pertaining to fire prevention ; and
WHEREAS, the 1984 Edition of the BOCA Basic/National Fire
Prevention Code, published by Building Officials and Code
Administrators International , Inc. , contains current nationally
recognized standards for fire prevention ; and
WHEREAS, three ( 3) copies of the 1984 Edition of the BOCA
Basic/National Fire Prevention Code have been on file with the
City Clerk for a period of ninety ( 90 ) days prior to the
adoption of this ordinance,
^ NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF CAPE GIRARDEAU, MISSOURI AS FOLLOWS:
SECTION 1 . Sections 11-1 through 11-319 of the Code of
Ordinances of the City of Cape Girardeau, Missouri are hereby
repealed.
SECTION 2. The City of Cape Girardeau hereby adopts the
1984 Edition of the BOCA Basic/National Fire Prevention Code,
published by Building Officials and Code Administrators
International , Inc. , a copy of which is attached to this
ordinance and incorporated herein by reference , with the
exceptions set forth in Section 3 of this ordinance .
SECTION 3. Chapter 11 of the Code of Ordinances of the
City of Cape Girardeau, Missouri , is hereby amended by adding
the following sections:
"Sec. 11-1 . Title .
This chapter shall be known as "The Fire Prevention Code
of the City of Cape Girardeau. "

/�, Sec. 11-2. BOCA Basic/National Fire Prevention Code/1984
Adopted .
The City of Cape Girardeau hereby adopts the 1984
Edition of the BOCA Basic/National Fire Prevention Code,
published by Building Officials and Code Administrators
International , Inc. , except such portions as are hereafter
deleted, modified or amended . Three ( 3) copies of the 1984
Edition of the BOCA Basic/National Fire Prevention Code are
on file in the Office of the City Clerk and are available
for public use, inspection and examination .
Sec. 11-3. BOCA Basic/National Fire Prevention Code/1984--
Amendments .
The 1984 Edition of the BOCA Basic/National Fire
Prevention Code adopted by the City of Cape Girardeau is
hereby modified and amended in the following respects :

( 2) Section F-100.1 on page 3 shall read as follows :
Title: These regulations as set forth herein shall be
part of the Fire Prevention Code of the City of Cape
Girardeau, Missouri, and are herein referred to as the
Fire Prevention Code or as "this code . "
( 3) Section F-102.1 on page 4 is hereby modified, changed
and amended to read as follows :

Enforcement Officer : The city manager shall designate
an enforcement officer to enforce the provisions of
the Fire Prevention Code as herein set forth . The
designated enforcement officer of this Code is herein
referred to as the Fire Official .
( 4) Section F-104 . 1 on page 7 is hereby modified, changed
and amended to read as follows :
Appeals : Appeals may be taken by any person aggrieved
by any decision or interpretation of the fire official
made under the provisions of this Code to the Board of
Appeals established in Section 7-3 of the Code of
Ordinances of the City of Cape Girardeau, Missouri ,
under the procedures set forth in that section.
( 5) Section F-3000. 2 on page 161 is hereby modified,
changed and amended to read as follows:
Permit r.equired: A permit shall be obtained from the
fire official for each installation of liquified
petroleum gas utilizing storage containers of 125
gallons or more individual water capacity. Prior to
making such an installation , an installer shall submit

�"'� plans to the fire official and if compliance with the
requirements of this code is shown by said plans , a
permit shall be issued .
Sec. 11-4. Penalties .
Any person who shall violate a provision of the 1984
Edition of the BOCA Basic/National Fire Prevention Code or
shall fail to comply with any of the requirements thereof
shall be guilty of an offense punishable by a fine of not
more than Five Hundred Dollars ($500. 00 ) or by imprisonment
not exceeding ninety ( 90 ) days or by both such fine and
imprisonment. Each day that a violation continues shall be
deemed a separate offense .
Sec. 11-5. Shaftways ; signs requirede
All trapdoors, except those which are automatic in their
operation , in any factory building or buildings used for
storage shall be closed at the completion of the business
of each day. Every outside window in a building used for
manufacturing purposes or for storage which opens directly
on any hoistway or other vertical meant: of communication
between two ( 2) or more floors in such building, shall be
plainly marked with the word "Shaftway" in red letters at
,,� least six ( 6) inches high on a white background, such
�varning sign to be so placed as to be easily discernible
from the outside of the building. Every door or window
opening on such shaftway from the interior of the building,
unless the construction of the partition surrounding the
shaftway is of such diskinctive nature as to make its
purpose evident at a glance, shall be similarly marked with
the warning word "Shaftway" so placed as to be easily
visible to any one approaching the shaftway :rom the
interior of the building.
SECTION 4. The repeal of Sections 11-1 tllrough 11-319 of
the Code of Ordinances of the City of Cape Girardeau, Missouri ,
provided for in Section 1 of this ordinanc.e shali not affect
the validity of any permits granted thereunder acld shall not
affect any offense or act cornmitted or done or any penalty or
forfeiture incurred before the effective date of this ordinance .
SECTION 5 . If any section , subsection , sentence , clause,
phrase or portion of this ordinance is for any reason held
invalid or unconstitutional by any Court of compr,tent
jurisdiction, such portion shall be deemed a separate, distinct
and independent provision and such holding sha�l not affect the
validity of the remaining portions hereof .
SECTION 6. This ardinance shall be in full i�:�rce and
effect ten days after its pawsage and approval .
