BILL NO. 84-77 ORDINANCE NO. �
AN ORDINANCE ACCEPTING AN EASEMENT FOR SEWERS
IN SEWER DISTRICT NO. 12-PP-2-A FROM NEUROLOGIC
PARTNERSHIP, IN THE CITY AND COUNTY OF CAPE
GIR.ARDEAU, MISSOURI
WHEREAS, Neurologic Partnership, a general partnership, by
Robert E. Gardner, Partner and David Lee, Partner, has executed
an easement for sewers in Sewer District 12-PP-2-A, conveying to
the City of Cape Girardeau, Missouri land all in the City of Cape
Girardeau, Missouri as more fully described hereinafter in the
ordinance, and the City desires to accept such easement and have
the same recorded;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
CAP� GIRARDEAU, MI5SOURI, AS FOLLOWS:
SECTION l. The City of Cape Girardeau, Missouri, hereby
accepts an easement for sewers, executed by Neurologic Partner-
ship, by Robert E. Gardner, Partner and David Lee, Partner,
conveying to the City of Cape Girardeau, Missouri, an easement
for sewers in Sewer District No. 12-PP-2-A, on the following
described real estate being fifteen (15) feet wide and seven and
one-half (7 1/2) feet on either side of the following centerline,
located in the City and County of Cape Girardeau, Missouri :
Commence at the most Northerly NE corner of Lot No. One (1)
of Professional Heights Subdivision; thence North 85° 08 '
West along the North line of said Lot No. One (1) 80 feet to
the point of beginning; thence North 29° 35 ' 15" West 30
feet and there terminating.
and it is ordered that said easement be recorded in the Office of
the Recorder of Deeds of Cape Girardeau County, Missouri.
SECTION 2 . This easement hereby conveyed as described in
Section 1 hereof is for the purpose of enabling the City, its
agents, servants and assigns, to install, lay, erect, construct,
maintain, operate and repair a certain sewer pipe or sewer main
which is to be placed in, on, upon, or across said property
described, together with all the useful, necessary and proper
adjuncts, appurtenances, manholes and appliances in connection
therewith.

SECTION 3. This ordinance shall be in full force and effect
ten days after its passage and approval.
