BILL NO. 84-67 ORDINANCE NO. ��-�
AN ORDINANCE ACCEPTING A PERMANENT EASEMENT FOR RIGHT-OF-WAY
FROM THOMAS J. AND ROSEMARY WHITTARD, FOR A PORTION OF FIFTH
STREET RIGHT-OF-WAY, CITY AND COUNTY OF CAPE GIRARDEAU,
MISSOURI
WHEREAS, Thomas J. and Rosemary Whittard, husband and wife,
have executed a Permanent Easement for Right-of-Way, conveying to
t.he City of Cape Girardeau, Missouri, a parcel of land for a
portion of Fifth Street right-of-way, as more fully described
hereinafter in this Ordinance, and the City desires to accept
such Permanent Easement for Right-of-Way and have the same recorded;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI , AS FOLLOWS :
SECTION l . The City of Cape Girardeau, Missouri, hereby
accepts a Permanent Easement for Right-of-Way executed by Thomas
J. and Rosemary Whittard, husband and wife, conveying to the City
of Cape Girardeau, Missouri, the following described real estate
located in the City and County of Cape Girardeau, Missouri:
Part of Lot 7 , Block 11 of Red Star Addition in the City
of Cape Girardeau more particularly described as follows :
Begin at the Southwest corner of Lot 7 , Block 11 of Red
Star Addition; thence Northerly along the East right-of-way
of Big Bend Road 31 . 03 feet to a point ; thence Easterly
parallel to the South right-of-way of Fifth Street 96 . 47
feet to a point on the North right-of-way of Fifth Street ;
thence Westerly along said North right-of-way 96 . 75 feet to
the point of beginning; containing 1479 .4 square feet more
or less .
SECTION 2 . It is ordered by the Council of the City of Cape
Girardeau, that said easement be recorded by the City Clerk in
the Office of the Recorder of Deeds of Cape Girardeau County,
Missouri.
SECTION 3 . This ordinance shall be in full force and effect
ten days after its passage and approval.

PERI�ANENT EASEMENT FOR RIGHT-OF-WAY
KNOW ALL MEN BY THESE PRESENTS: Thomas J. Whittard and
Rosemary Whittard, his wife, for good and valuab�e consideration
received, do hereby grant, bargain, sell and convey to the City
of Cape Girardeau, Missouri, a Municipal Corporation, a permanent
easement for right-of-way for a public street in and upon the
following parcel of land:
Part of Lot 7, Block 11 of Red Star Addition in the
City of Cape Girardeau more particularly described as
follows:
Begin at the Southwest corner of Lot 7, Block 11 of Red
Star Addition; thence Northerly along the East right-of-way
of Big Bend Road 31. 03 feet to a point; thence Easterly
parallel to the South right-of-way of Fifth Street 96. 47
feet to a point on the North right-of-way of Fifth Street;
thence Westerly along said North right-of-way 96. 75 feet to
the point of beginning; containing 1479 .4 square feet more
or less.
This easement shall run with the land and inure to and be
binding upon the successors in title of the respective parties.
IN WITNESS WHEREOF, the undersigned have executed this
easement this 27th day of June , 1984 .
