AN ORDINANCE AMENDING SECTION 11-355 OF THE CITY
CODE PERTAINING TO FIREWORKS SAFE'1'Y REQUIREMENTS
BY MODIFYING THE DISTANCE REQUIREMENTS FOR THE
DISCHARGE OF FIREWORKS AND THE LOCATION OF FIREWORKS
STANDS
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI , AS FOLLOWS:
SECTION l. Section 11-355 (G) of the Code of Ordinances of
the City of Cape Girardeau, Missouri, reading as follows:
"G. No fireworks shall be sold or discharged within 600
feet of any church, hospital or school building. "
is hereby repealed.
SECTION 2 . A new Section 11-355 (G) of the Code of Ordinances
of the City of Cape Girardeau, Missouri, is hereby enacted to
read as follows :
"G. No fireworks shall be sold or discharged within 300
feet of any church, hospital or school building. "
SECTION 3. Section 11-355 (K) of the Code of Ordinances of
the City of Cape Girardeau, Missouri, reading as follows:
"K. No fireworks shall be sold other than at a licensed
fireworks stand. No fireworks stand shall be located
within fifty (50) feet of any building. "
is hereby repealed.
SECTION 4. A new Section 11-355 (K) of the Code of Ordinances
of the City of Cape Girardeau, Missouri, is hereby enacted to
read as follows:
"K. No fireworks shall be sold other than at a licensed
fireworks stand. No fireworks stand shall be located
within twenty-five (25) feet of any building of masonry
construction or within fifty (50) feet of any building
not of non masonry construction. "
SECTION 5. If any section, subsection, sentence, clause,
phrase or portion of this ordinance is for any reason held
invalid or unconstitutional by any Court of competent jurisdic-
tion, such portion shall be deemed a separate, distinct and

independent provision and such holding shall not affect the
validity of the remaining portions hereof.
SECTION 6 . It is hereby found and declared that an emer-
gency exists as provided for in Section 3.15 of the City Charter
for the City of Cape Girardeau, Missouri, in that the requirements
of the current ordinance are unduly restrictive and would cause
hardship to a number of businesses if not modified prior to the
1984 fireworks season.
SECTION 7. This ordinance shall be in full force and effect
from and after its final passage.
