AN ORDINANCE ACCEPTING A STREET EASEMENT FROM
GENE AND RAE WARD, FOR A PORTION OF CAROLEWOOD
STREET RIGHT-OF-WAY, CITY AND COUNTY OF CAPE
GIRARDEAU, MISSOURI
WHEREAS, Gene Ward and Rae Ward, husband and wife, have
executed a Street Easement, conveying to the City of Cape Girardeau,
IKissouri, a parcel of land for a portion of Carolewood Street
right-of-way, as more fully described hereinafter in this Or-
dinance, and the City desires to accept such Street Easement and
have the same recorded;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI, A� rOLLOWS:
SECTION l . The City of Cape Girardeau, Missouri, hereby
accepts a Street Easement executed by Gene Ward and Rae Ward,
husband and wife, conveying to the City of Cape Girardeau, Missouri,
the following described real estate located in the City and
County of Cape Girardeau, Missouri :
A parcel of ground enclosed by a circle lying in Township 31
North, Range 13 East, the Northeast Half of the Southeast
Quarter of Section 27, City and County of Cape Girardeau,
State of Missouri, more fully described as follows:
Begin at the centerline of existing Carolewood Street at its
western most point in Carolewood Estates Subdivision, and
continue North 89° 20' West, to a centerpoint for a circle
with a radius of 42 feet, which circle intersects Carolewood
Estates Subdivision at either side of existing Carolewood
Street.
SECTION 2 . It is ordered by the Council of the City of Cape
Girardeau, that said easement be recorded by the City Clerk in
the Office of the Recorder of Deeds of Cape Girardeau County,
Nissouri.
SECTION 3 . This ordinance shall be in full force and effect
ten days after its passage and approval .

STREET EASEMENT
KNOW ALL MEN BY THESE PRESENTS:
Gene Ward and Rae Ward, husband and wife, in consideration of
the sum of One Dollar ($1) and other good and valuable consideration,
the receipt of which is hereby acknowledged, do hereby grant, bargain,
and convey to the City of Cape Girardeau, Missouri, a municipal corpora-
tion, hereinafter called "City", the right, privilege, permission, and
authority to enter on and upon the following described property located
in the City and County of Cape Girardeau, Missouri, to-wit:
A parcel of ground enclosed by a circle lying in Township
31 North, Range 13 East, the Northeast Half of the Southeast
Quarter of Section 27, City and County of Cape Girardeau,
State of Missouri, more fully described as follows:

Said right, privilege, permission, and authority to enter on or

upon said property above described is irrevocable and is granted for �
the purpose of enabling the City, its agents, servants, and assigns,
to maintain a temporary turn around at the western most end of existing
Carolewood Street, by grading, and ditching, with all the rights of the
City to forever cease upon completion of "the construction of Carolewood
Street to the west.
