AN ORDINANCE AMENDING SECTION 16-194 OF THE CITY
CODE BY ELIMINATING THE REQUIREMENT THAT A ONE
HUNDRED DOLLAR DEPOSIT BE MADE WHEN APPLYING FOR
A HOTEL/MOTEL/RESTAURANT GROSS RECEIPTS LICENSE
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
SECTION l. Section 16-194 of the Code of Ordinances of the
City of Cape Girardeau, Missouri, reading as follows :
"Sec. 16-194 . Licenses; Payment of Tax.
No person, firm or corporation shall operate a hotel,
motel or restaurant without a current license obtained
pursuant to the terms of this Article. Application for such
license shall be made to the City Collector on forms pre-
scribed by him. Licenses issued under this Article shall be
issued on a calendar year basis. Applications for license
renewals shall be filed in December of each year. Each
initial license application shall be accompanied by a One
Hundred Dollar ($100 . 00) deposit which shall be credited to
the last license tax payment owed by licensee. The license
tax due under this Article shall be paid to the City Collector
monthly and shall be payable on or before the 20th day of
each month for the license tax due for the preceding month. "

SECTION 2. A new Section 16-194 of the Code of Ordinances
of the City of Cape Girardeau, Missouri, is hereby enacted to
read as follows:

SECTION 3. If any section, subsection, sentence, clause,
phrase or portion of this ordinance is for any reason held invalid
or unconstitutional by any Court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining portions hereof.
SECTION 4 . This ordinance shall be in full force and effect
ten days after its passage and approval .
