HomeMy WebLinkAboutOrd.139.03-21-1984 *� . - . . . • � . ` BILL NO. 84-12 ORDINANCE IQO. � � C —� AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF THE CITY OF CAPE GIR.ARDEAU, MISSOURI , BY CHANGING THE ZONING OF PART OF LOT l, OF A SUBDIVISION OF 400 ARPENS KNOWN AS THE RODNEY TRACT IN U.S.P. SURVEY NO. 2199, CITY AND COUNTY OF CAPE GIRARDEAU, MISSOURI, FROM R-1 TO M-1 AND C-2 WHEREAS, Cape Ready Mix Co. , Inc . and John G. and Mary Ellen Welch applied for a rezoning of their property described in Sections 1 and 3 of this ordinance from R-1 to M-l; and WHEREAS, the City Planning and Zoning Commission has recom- mended that the rezoning request be denied; and WHEREAS, Cape Ready Mix Co. , Inc . and John G. and Mary Ellen Welch timely submitted a written request for a public hearing before the City Council as provided for in Chapter 30 of the Code of Ordinances of the City of Cape Girardeau; and WHEREAS, Cape Ready Mix Co. , Inc. and John G. and Mary Ellen Welch have amended their rezoning request and now seek to have the property described in Section 1 of this ordinance rezoned from R-1, Single-Family Dwelling District to M-1, Light Industrial District and the property described in Section 3 of this ordinance rezoned from R-1, Single-Family Dwelling District to C-2, General Commercial District; and WHEREAS, Public notice of the rezoning request was given a_s prescribed by Chapter 30 of the Code of Ordinances of the City of Cape Girardeau, Missouri, and public hearing was held on Wednesday, February l, 1984; and WHEREAS, the City Council of the City of Cape Girardeau, Missouri, has elected to rezone the property described in Section 1 from R-1, Single-Family Dwelling District to M-1, Light Indus- trial District; and has elected to rezone the property described in Section 3 from R-1, Single-Family Dwelling District to C-2, General Commercial District; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS: SECTION 1 . Chapter 30 of the Code of Ordinances of the City of Cape Girardeau, Missouri, is hereby amended to change the zoning from the present R-1, Single-Family Dwelling District to M-1, Light Industrial District, for the following desc-ribed property: . ^ ,; , ' �A, � ��1��' �� 1 , • _ . , Al1 that part of Lot one (1) of a Subdivision of 400 Arpens known as the Rodney tract in U.S.P. Survey No. 2199, in the City of Cape Girardeau, Missouri, described as follows: Start at the point where the South line of Lot 1 of the Rodney 400 Arpen Tract (being also the North line of Outlot 86 of U.S.P. Survey No. 2199) intersects the West right-of- way line of U.S. Highway 61; thence North 82° 15 ' West, 199. 3 feet for the point of beginning; thence continue North 82° 15 ' West, 849. 5 feet to the southwest corner of the Welch. Tract; thence North 24° 45 ' West, 116. 79 feet; thence North 66° East, 637 . 95 feet; thence North 53° 30 ' East, 290. 05 feet; thence North 52° 15 ' East, 69 . 62 feet; thence 5outh 28° 25 ' East, 88 . 32 feet; thence South 2° 05 ' West, 618 feet to the point of beginning. SECTION 2. The City Council hereby finds and declares that the property described in Section 1 hereof is at the present time particularly suitable for the purposes and uses of M-1, Light Industrial District, and that such changes authorized hereby are reasonable and in reasonable conformity with the existing uses and value of the immediately surrounding properties. SECTION 3 . Chapter 30 of the Code of Ordinances of the City of Cape Girardeau, Missouri, is hereby amended to change the zoning from the present R-1, Single-Family Dwelling District to C-2, General Commercial District, for the following described property: All that part of Lot one (1) of a Subdivision of 400 Arpens known as the Rodney tract in U. S.P. Survey No. 2199, in the City of Cape Girardeau, Missouri, described as follows : 5tart at the point where the South line of Lot 1 of the Rodney 400 Arpen Tract (being also the North line of Outlot 86 of U. S.P. Survey No. 2199) intersects the West right-of- way line of U.S. Highway 61; thence North 82° 15 ' West, 1048 . 8 feet; thence North 24° 45 ' West, 116 . 79 feet for the point of beginning; thence continue North 24° 45 ' West, 125. 01 feet to a point in the South line of the Bloomfield Road; thence along the South line of Bloomfield Road North 66° East, 625. 9 feet; thence North 53° 30 ' East, 275 feet; thence North 52° 15 ' East, 88 . 8 feet; thence South 28° 25 ' East, 126 . 68 feet; thence South 52° 15 ' West, 69 . 62 feet; thence South 53° 30 ' West, 290. 05 feet; thence South 66° West, 637 . 95 feet to the point of beginning. SECTION 4 .
