AN ORDINANCE ACCEFTING A SEWER EASEMENT IN SEWER
DISTRICT 12-LL-lA, FROM DRURY DEVELOPMENT CORPORATION,
IN THE CITY AND COUNTY OF CAPE GIRARDEAU, STATE
OF MISSOURI
WHEREAS, Drury Development Corporation has executed a sewer
easement in Sewer District 12-LL-lA, conveying to the City of
Cape Girardeau, Missouri, land all in the City of Cape Girardeau
and all as more fully described hereinafter in the ordinance, and
the City desires to accept such easement and have the same recorded;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
CAPE GIR.ARDEAU, MISSOURI, AS FOLLOWS:
SECTION 1. The City of Cape Girardeau, Missouri hereby
accepts a sewer easement in Sewer District 12-LL-lA, executed by
Drury Developrnent Corporation, conveying to the City of Cape
Girardeau, Missouri a sewer easement in Sewer District No. 12-LL-
lA, on the following described real estate located in the City
and County of Cape Girardeau, Missouri:
Part of Lot 2 of the Rodney 400 Arpen Tract,
U. S.P.S. 2199, Township 30 North, Range 13 East, City
and County of Cape Girardeau, State of Missouri, described
as follows:
A strip of land 15 feet wide, the center line of
which is described as follows:
Start at the northwest corner of Lot 1, Block l,
of Edgewood Highlands Eighth Subdivision; thence N. 11°
58 ' E. , 25. 07 feet to the point of beginning; thence
7 . 5 feet each side of the extension of the centerline
of Barberry Street, N. 82° 12 ' W. , 226 . 91 feet; thence
5 feet west of and 10 feet east of the following lines,
N. 0° 04 ' W. , 350. 0 feet; thence N. 8° 00 ' W. , 218. 0
feet; thence 5 feet south of and 10 feet north of the
following line, N. 89° 12 ' W. , 279. 0 feet; thence 5
feet west of and 10 feet east of the following line, N.
3° 30 ' W. , 410. 0 feet.
The grant of this easernent is subject to existing
easements for roads and other utilities if any and

grantee shall at its expense repair all damage done by
grantee only to grantors �roperty occasioned by the
construction, operation and maintenance of said underground
sewer line.
and it is ordered that said easement be recorded in the Office of
the Recorder of Deeds of Cape Girardeau County, Missouri.
SECTION 2. The easement hereby conveyed as described in
Section 1 hereof is for the pur�ose of enabling the City, its
agents, servants and assigns, to install, lay, erect, construct,
maintain, operate and repair a certain sewer pipe or sewer main
which is to be placed in, on, upon, or across said property
described, together with all the useful, necessary and proper
adjuncts, appurtenances, ntanholes and appliances in connection
therewith.
SECTION 3. This ordinance shall be in full force and effect
ten days after its passage and approval.
