AN ORDINANCE ACCEPTING AN EASEMENT FOR SEWERS IN
SEWER DISTRICT N0. 14-L-2, FROM CAPE RETIREMENT
COMMUNITY, INC. , IN THE CITY AND COUNTY OF CAPE
GIRARDEAU, STATE OF MISSOURI
WHEREAS, Cape Retirement Community, Inc. , a Missouri Corporation,
has executed an easement for sewer in Sewer District No. 14-L-2,
conveying to the City of Cape Girardeau, Missouri, land all in
the City of Cape Girardeau and all as more fully described herein-
after in the ordinance, and the City desires to accept such
easement and have the same recorded;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
S;;CTION 1. The City of Cape Girardeau, Missouri, hereby
accepts an easement for sewers, executed by Cape Retirement
Community, Inc. by Martha Leta Bahn, President, conveying to the
Ci'cy of Cape Girardeau, an easement for sewers in Sewer District
No. 14-L-2 on the following described real estate located in the
City and County of Cape Girardeau, Missouri:
Part of Outlot 83, U. S. Private Survey 2199, being a
strip of land 10 feet in width, lying 5 feet either side of
the following described center line: Start at the inter-
section of the east line of Mt. Auburn Road and the north
line of Independence Street; thence S. 84° 47 ' E. , with the
north line of Independence Street, 895. 4 feet to the point
of beginning; thence N. 14° 43 ' W. , 470 . 0 feet and there
terminating.
and it is ordered that said easement be recorded in the Office of
the Recorder of Deeds of Cape Girardeau County, Missouri.
SECTION 2 . The easement hereby conveyed as described in
Section 1 hereof is for the purpose of enabling the City, its
agents, servants and assigns, to install, lay, erect, construct,
maintain, operate and repair a certain sewer pipe or sewer main
which is to be placed in, on, upon, or across said property
described, together with all the useful, necessary and proper
adjuncts, appurtenances, manholes, and appliances in connection
therewith.
SECTION 3 . This ordinance shall be in full force and effect
