HomeMy WebLinkAboutOrd.02.04-19-1982 . . ,. , ti � • , , BILL NO. � -� � ORDIl°dANCE NO. � AN O�:�INANCE GRANTING A SP�CIAL USE PERI�lIT TO P�iISSOURI UTILITIES CONIPANY, FOR PURPOSES OF CONSTRUCTING, N,'AINTAINING AND OPERAi IiJG A i.'/IETT�L BUILDING FOR STORAGE AND A MAIN'I'ENANCE SHOP, ON LOTS 3 , 4, AND 5, BLOCK "I" AND LOTS 3, 4, AND 5, BLOCK "J" , ITv CAPE ROCK HILLS, IN THE CITY AND COUNTY OF CAPE GIRARDEAU, MISSUURI WHEREAS, NTissouri Utilities Company is the owner of certain property in the City of Cape Girardeau, Missouri, on which it desires to construct, maintain and o�erate a metal building to be used for starage and as a maintenance shop; and WHEREAS, the proposed location of said building is 20 East Cape Rock Drive, which said property is presently zoned R-1, Sinr�le-Family Dwelling District; and WHEREAS, a Special Use Permit is required for said building use in a R-1 zone; N04V, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU, i�IISSOURI, AS FOLLOLVS: SECTION l. The City Council having duly considered the application finds thai. tne qrantinq of the Special Use Permit will not substantially increase traffic hazards, congestion, fire hazards or adversely affect the general character of the neighbor- hood or the general welfare of the community, nor will i� overtax public utilities or be in conflict with the comprehensive �lan. SECTION 2. A Special Use Permit for purposes of constructing, maintaining and operating a metal building to be used for storage and as a maintenance shop, on the following described property: A tract of land located in the City of Cape Girardeau, County of Cape Girardeau, State of Missouri, consisting of: Al1 of Lots Numbers Three (3) , Four (4) and Five (5) in Block "I" and also Lots Nurnbers Three (3) , Four (4) and Five (5) in Block "3" , all in Cape Rock Hills, a subdivision of U. 5. Private Survey No. 3091, Township 31 North, Range 14 East, and all as laid down and designated in the Recoraer' s Office at Jackson, �issouri, in Plat �ook tnree (3) at Page twenty-nine (29) to which plat and subdivision, reference is hereby made for a more particular description of said lots. is hereby granted to P�issouri Utilities Company, to be effective ten (10) days after the date of passage and approval of this j , ` �' � .� I`� ;�. , � • � • �• , . ordinance. The Special Use Permit must comply with all regulations set forth in the Zoning Code for the district in which the use is located except those which have been specifically excepted under this permit, all other applicable ordinances of the City of Cape Girardeau and any special conditions contained in the Special Use Permit, a co�y of which is attached hereto, marked Exhibit "A" and incor�orated herein by reference. The City Manager is hereby given the power to execute the S�oecial Use Permit for and on behalf of the City of Cape Girardeau, Missouri. SECTION 3. Tnis ordinance shall be in full force and effect ten days after its �assage and a�proval. S . Private Survey No. 3091, Township 31 North, Range 14 East, and all as laid down and designated in the Recorder ' s Office at Jackson, Missouri, in Plat Book three (3) at Page twenty-nine (29) to which plat and subdivision, reference is hereby made for a more particular description of said lots. This Special Use Permit is granted upon the condition that the Applicant be bound by all City Ordinances which pertain to the Special Use Permit and that the Applicant be bound by the following conditions which are imposed as a condition of issuance of this Special Use Permit. Upon the failure of the Applicant to comply with these special conditions, the Special Use Perrnit will automatically terminate with the right of the City of Cape Girardeau to enter upon the land to abate such special use. SPECIAL CONDITIONS: l. Additions or rnodifications from the original building permit must be approved by the City Council . 2 . Special Use shall meet all zoning regulations. 3 . This Special Use Permit shall be binding upon the heirs , executors, successors and assigns of Missouri Utilities Company.
