AN ORDINANCE APPROVING THE FORM OF ATd A�'�3ENDNENT
TO THE URBAN PLAiQNING CONTRACT BETV�7EEN TiiE CITY
OF CAPE GIRARD�AU, MISSOURI APND THE SOUTHEAST
MISSOURI REGIONAL PLANNIiVG AP1D ECO�iOMIC DEVELOP-
MENT COMI�IISSION, AUTHORIZING THE T'iAYOR TO EX�CUTE,
AU'I°HORIZIP3G irlE PAYMENT OF A SUM OF I�lONEY
W�EREAS, the City of Cape Girardeau, Missouri and Lhe South-
east Missouri Regional Planning and Economic Development Commission
entered into an Urban Planning Contract on July l, 1981; and
6JH�REAS, said Contract needs to be amended;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI, AS FOLLOV�'S:
SECTIOTv l. The "Amend.ment to the Urban Planning Contract" ,
copy attached hereto marked Exhibit "A" , between the City of Cape
Girardeau, Missouri and the Southeast Nissouri Regional Planning
and Economic Development Commission is approvecl as to form.
SECTION 2 . The Mayor of the City of Cape Girardeau, Niissouri,
is hereby autnorized and directed to execute said Ainendment, for
and on behalf of the City of Ca�e Giraraeau, Missouri .
SEC�°ION 3. Payment of a sum of money k�y the City of Cape
Girardeau, NZissouri to the Southeast Missouri Regional Planninr
and Economic Development Commission is hereby authorized to be
made in accordance with the terms and provisions of said Contract.
SECTION 4 . This ordinance shall be in full force and effect
ten days after its passage and approval .

AMENDMENT TO THE
URBAN PLANNING CONTRACT
BY AND BETWEEN
THE CITY OF CAPE GIRARDEAU
AND
THE SOUTHEAST I�9ISSOURI REGIONAL PLANNING
AND ECONOMIC DEVELOPMENT COb1�iISSION
PERRYVILLE, MISS011RI
WHEREAS, the City of Cape Girardeau and the Southeast I�lissouri Regional
Planning and Economic Development Commission entered into an Urban Planning
Contract on the lst day of July, 1981; and,
WHEREAS, Article I, Paragraph e, authorizes the amendment of said
contract upon mutual agreement of the parties thereof; and,
WHEREAS, it has been mutually agreed between the City and the Commis-
sion to amend the aforementioned contract in order to provide sufficient
funding and extend the completion date of said contract for the purposes
of professionally completing the research and planning tasks having been
assigned to the Commission's staff by officials of the City of Cape Girardeau;
NOiV, THEREFORE, it is mutally agreed to amend Article XI (Time of
Performance) , Paragraph a, to read, "Al1 services required hereunder shall
be completed and submitted to the City on or before the expiration of
eighteen (18) consecutive calendar months foliowing the date of this con-
tract. "
FURTHER, it is agreed to amend Article XII (Compensation to the Com-
mission) , Paragraph one, to read, "The City agrees to pay the Commission
the total sum of Ten Thousand Dollars ($10,000.00) for the services set
forth in Appendix A . . . ."
It is also agreed to amend the Schedule of Compensation by adding
three additional payments from the City to the Commission as follows:
The first payment to be made upon acceptance of the amendment to
the contract by the City of Cape Girardeau in the amount of One Thousand
Six Hundred Sixty-Six Dollars ($1,666.00) .
The second payment to be made in the amount of One Thousand Six Htm dred
Sixty-Six Dollars (�1 ,666.00) on or before June 1, 1982.
The third and final payment to be made in the amount of One Thousand
Six Hundred Sixty-Eight Dollars ($1,668.00) on or before October l, 1982 .
IN iVITNESS L9HEREOF, the parties hereto have executed this contract
amendment agreement April 1, 1982.
