AN ORDINANCE REPEALING SECTION 26-200 OF THE
CITY CODE AND ENACTING A NEW SECTION 26-200
IN LIEU THEREOF RELATING TO LEAVING THE
SCENE OF A MOTOR VEHICLE ACCIDENT
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE
GIRARUEAU, MISSOURI , AS FOLLOWS:
SECTION l . Section 26-200 of the Code of Ordinances of the
City of Cape Girardeau , Missouri is hereby repealed in its
entirety.
SECTION 2 . A new Section 26-200 of the Code of Ordinances
of tne City of Cape Girardeau, Missouri , is hereby enacted, to
read as follows:
Sec . 26-200 . Unlawful to leave scene of accident .
a . A person commits the crime of leaving the
scene of a notor vehicle accident when being the
operator or driver of a vehicle on the highway or
r, on any publicly or privately owned parking lot or
parking facility generally open for use by ttie
public and knowing that an injury has been caused
to a person or damage has been caused to
property, due to his culpability or to accident,
he leaves the place of injury, damage or accident
without stopping and giving his name, residence,
including city and street number , motor vehicle
number and chauffeur ' s or registered operator ' s
number , if any, to the injured party or to the
operator or owner of the damaged vehicle or
property, or to a police officer ; or if no police
officer is in the vicinity, then to the nearest
police station or judicial officer .
b. For the purposes of this section , all peace
officers shall have jurisdiction, when invited by
an injured person , to enter the premises of any
privately owned parking lot or parking facility
for the purpose of investigating an accident and
performing all necessary duties regarding such
accident .

c. No person knowing that an injury has been
/'`� caused to a person or damage has been caused to
property, due to the culpability of another or to
accident shall remove the motor vehicle or the
operator of said motor vehicle from the place of
the injury, damage or accident without stopping
and giving his name, residence, including city
and street number , motor vehicle number and
chauffeur 's or registered operator 's number , if
any, to the injured party or to the operator or
owner of the damaged vehicle or property, or to a
police officer ; or if no police officer is in the
vicinity, then to the nearest police station or
judicial officer .
SECTION 3 . If any section , subsection, sentence, clause,
phrase or portion of this ordinance is for any reason held
invalid or unconstitutional by any court of competent
jurisdiction, such portion shall be deemed a separate, distinct
and independent provision and such holding shall not affect the
validity of the remaining portions hereof .
SECTION 4 . It is the intention of the governing body and
it is hereby ordained that the provisions of this ordinance
shall become and be made a part of the Code of Ordinances of
the City of Cape Girardeau, Missouri , and the sections of this
,.� Code may be renumbered to accomplish such intention.
SECTION 5 . The repeal of Section 26-200 provided for in
Section 1 hereof shall not affect any offense or act committed
or done or any penalty or forfeiture incurred before the
effective date of this ordinance .
SEC'I'ION 6 . This ordinance shall be in full force and
effect ten days after its passage and approval .
