HomeMy WebLinkAboutOrd.366.08-18-1986 � BILL N0. 86-123 ORDINANCE N0. 3 � � AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF THE CITY OF CAPE GIRARDEAU, MISSOURI , BY CHANGING THE ZOCIING OF PART OF DAVIS SUBDIVISION, CITY AND COUNTY OF CAPE GIRARDEAU, MISSOURI FROM R-1 TO R-3 WHEREAS, the City Planning and Zoning Commission has recommended that all of the property described in Section 1 of this ordinance should be rezoned from R-1 Single-Family Dwelling District to iZ-3 , Two-Family Dwelling District; and WHEREAS, Public Notice of such change was given as prescribed in Chapter 30 of the Code of Ordinances of the City of Cape Girardeau , Missouri , and public hearing was held on Monday, August 4 , 1986 ; and ti�HEREAS , the City Council of the City of Cape Girardeau , � Missouri , has elected to rezone the property described in Section 1 from R-1 , Single-Family Dwelling District to R-3 , Two-Family Dwelling District; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU, MISSOURI , AS FOLLOWS: SECTION 1 . Chapter 30 of the Code of Ordinances of the City of Cape Girardeau , Missouri , is hereby amended to change the zoning from the present R-1 , Single-Family Dwelling District to R-3 , Two-Family Dwelling District , for the following described property: Part of Lot One ( 1 ) of Davis Subdivision of a part of Out Lot 86 in Survey 2199 and part of Survey 174 , Township 30 North , Range 13 East, described as follows: Beginning at an old cedar post which is 37 . 48 ' from the intersection of Bloomfield Road and Silver Springs Road. Said cedar post being the Northeast corner of said land hereby conveyed to Sirnon Heisserer and wife; thence, running in a Southerly direction and along the West right-of-way of Silver Springs Road 468 . 5 ' ( feet ) to an iron pin on the right-of-way of said Silver Springs Road, being also the Southeast corner of said land of Heisserer ; thence, at 90° from Silver Springs r� Road and running West along other land of said Joseph Donogne, 380 . 0 ' ( feet ) to an iron pin in the Southwest corner of said land of Heisserer ; thence , running in a Northerly direction 378 . 1 ' ( feet ) to an old fence post - on the South right-of-way of the Bloomfield Road, the Northwest corner of said Heisserer ' s land; thence , running in an Easterly direction and along the South right-of-way of Bloornfield Road to an old Cedar Post and the place of beginning . Containing three acres of land . EXCEPT that part conveyed to the City of Cape Girardeau, Missouri by Quit Claim Deed recorded in Plat Book 400 at Page 634 . SECTION 2 . The City Council hereby finds and declares that the property described in Section 1 hereof is at tt�e present time particularly suitable for the purposes and uses of R-3 , Two-Family Dwelling District , and that such changes authorized hereby are reasonable and in reasonable conformity with the existing uses and value of the immediately surrounding properties .
